LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A MOTOR FUEL STATION, SPECIFICALLY TO INSTALL NEW PUMP ISLANDS, DISPENSERS AND CANOPY AND TO REVISE THE DRIVEWAY FOR PROPERTY ZONED C-1 COMMERCIAL DISTRICT LOCATED AT 4701 EXCELSIOR BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. The American Oil Company has made application to the City Council for a Conditional Use Permit under Section 14:5-5.2(D)(1)of the St. Louis Park Ordinance Code for the purpose of permitting a motor fuel station, specifically to install new pump islands, dispensers and canopy and to revise the driveway for property within a C-1 Commercial District located at 4701 Excelsior Boulevard for the legal description as follows, to -wit: See Attached Exhibit A - Legal Description 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 93 -47 -CUP) and the effect of the proposed modifications to a motor fuel station on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed modifications to a motor fuel station will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed modifications to a motor fuel station is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 4. The contents of Planning Case File 93 -47 -CUP are hereby entered into and made part of the public hearing record and the record of decision for this case. Conclusion The Conditional Use Permit to permit modifications to a motor fuel station, specifically to install new pump islands, dispensers and canopy and to revise the driveway at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan, Exhibit B - Landscape Plan and Specifications, and Exhibit C - Canopy Plan; such documents incorporated by reference herein. The bufferyard design along Excelsior Boulevard and adjacent Natchez Avenue shall take into account and be compatible with the streetscape design standards developed for Excelsior Boulevard and its construction shall be deferred to a date not later than October 31, 1995. In the event that the streetscape plan is not developed by August 31, 1995, the bufferyard shall be installed by October 31, 1995 in compliance with Exhibit B - Landscape Plan. In the event that the streetscape plan is approved by City Council before August 31, 1995, the applicant will have six months from that date to develop a plan which is compatible with the streetscape design standards and install appropriate materials. 3. All improvements, except landscaping identified in Condition No. 2 above, shall be completed by April 30, 1995. ATTEST: Revie ' ed for administration: 93-47-CUP:RES?
