LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT MODIFICATIONS TO A MOTOR FUEL STATION AND MOTOR VEHICLE SERVICE FOR PROPERTY ZONED C-2 COMMERCIAL DISTRICT LOCATED AT 5430 MINNETONKA BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Roger's Petroleum, Inc. has made application to the City Council for a Conditional Use Permit under Section 14:5-5.3(D)(1) of the St. Louis Park Ordinance Code for the purpose of permitting a motor fuel station and motor vehicle service, modified by removal of an existing pump island and canopy and relocation of the pump island to the east adjacent to other existing pump islands and expansion of canopy at this locations within a C-2 Commercial District located at 5430 Minnetonka Boulevard for the legal description as follows, to -wit: Lot 16, except the North 80 Feet thereof, and Lot 16, except the North 80 Feet thereof of Auditors Subdivision Number 351, Hennepin County Minnesota (Abstract) 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 94 -13 -CUP) and the effect of the proposed modifications to a motor fuel station and motor vehicle service on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the modifications to a motor fuel station and motor vehicle service will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed modifications to a motor fuel station and motor vehicle service is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 4. The contents of Planning Case File 94 -13 -CUP are hereby entered into and made part of the public hearing record and the record of decision for this case. Conclusion The Conditional Use Permit to permit modifications to a motor fuel station and motor vehicle service by removal of an existing pump island and canopy and relocation of the pump islands to the east adjacent to other existing pump islands and expansion of canopy in this location on the site at the location described is granted based on the findings set forth above and subject to the following conditions: 44 I v. fir 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan with the contingency that the driveway setback shall comply with Ordinance requirements and Exhibit B - Landscaping Plan, such documents incorporated by reference herein, as modified by the following: An additional 14 plant units should be provided on the westerly side of the property to satisfy the Bufferyard C requirements and an additional 53 plant units shall be provided on the northeast portion of the property between the car wash building and the north property line to comply with the Bufferyard B requirements. 2. All improvements shall be completed by April 30, 1995.
