RESOLUTION NO.
94-120
RESOLUTION INDEMNIFYING AND HOLDING HENNEPIN COUNTY
HARMLESS FOR THE CONSTRUCTION AND EXISTENCE OF STREETSCAPE PLANTER BOXES;
ASSURING THAT ADEQUATE SNOW STORAGE WILL BE PROVIDED AND
ASSURING THAT SNOW WILL BE REMOVED FROM THE BOULEVARD
ON COUNTY STATE AID HIGHWAY NO. 3 (EXCELSIOR BOULEVARD)
WHEREAS, the City Council desires to construct certain Streetscape
improvements, including the planter boxes along County State Aid Highway No. 3
(Excelsior Boulevard) between Trunk Highway 100 and Quentin Avenue, under
Project No. 93-23; and
WHEREAS, Hennepin County has agreed to allow the construction of the
proposed improvements if the City of St. Louis Park assumes all responsibility
for maintenance and repair and holds Hennepin County harmless for all claims,
judgments and actions arising out of negligent performance of the City, its
Contractor, its employees and its officers in the construction and maintenance
of the Streetscape improvements and if the City assures that adequate snow
storage will be provided and that snow plowed onto the boulevard will be
removed.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of St.
Louis Park, Minnesota, that the City hereby saves, defends and holds harmless
Hennepin County against all claims, demands, judgments, fines, penalties,
expenses, actions or causes of action of any kind arising out of or by reason
of the construction and existence of the planter boxes.
BE IT FURTHER RESOLVED that the City Council affirms its intent to
provide adequate snow storage along the boulevard and remove snow plowed onto
the boulevard by the County.
