HomeMy WebLinkAbout94-10 - ADMIN Resolution - City Council - 1994/02/07r ir RESOLUTION NO. 94-10 RESOLUTION GIVING APPROVAL FOR PRELIMINARY PLAT OF EXCELSIOR TOWNHOMES BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. Nader Noorshokry and Good Value Homes, Inc., owners and subdividers of the land proposed to be platted as Excelsior Townhomes have submitted an application for approval of preliminary plat of said subdivision in the manner required for platting of land under the St. Louis Park Ordinance Code, and all proceedings have been duly had thereunder. 2. The proposed preliminary plat has been found to be in all respects consistent with the City Plan and the regulations and requirements of the laws of the State of Minnesota and the ordinances of the City of St. Louis Park. 3. The proposed plat is situated upon the following described lands in Hennepin County, Minnesota, to -wit: The East 245.00 feet of the Southeast Quarter of the Northwest Quarter of Section 20, Township 117, Range 21, Hennepin County, Minnesota, lying southerly and southwesterly of a line to be hereinafter known as Line A and described as beginning at a point in the east line of said Southeast Quarter of the Northwest Quarter, 564.08 north of the southeast corner thereof, said point to be hereinafter known as Point A; thence westerly at right angles to said east line on an assumed bearing of North 89 degrees 29 minutes 50 seconds West, 150.00 feet, to a point to be hereinafter known as Point B; thence North 51 degrees 12 minutes 24 seconds West 197.47 feet and said line A there terminating. Together with that part of said Southeast Quarter of the Northwest Quarter described as beginning at said previously described Point A; thence north 65.00 feet along said east line of the Southeast Quarter of the Northwest Quarter; thence North 89 degrees 29 minutes 50 seconds West 32.00 feet.; thence South 00 degrees 30 minutes 10 seconds West parallel with said east line, a distance of 45.00 feet; thence South 54 degrees 28 minutes 15 seconds West 34.00 feet to said Line A; thence South 89 degrees 29 minutes 50 seconds East 59.50 feet along said Line A to the point of beginning. Together with that part of said Southeast Quarter of the Northwest Quarter described as commencing at said previously described Point B; thence North 51 degrees 12 minutes 24 seconds West 121.04 feet along said previously described Line A to the point of beginning of the parcel to be described: thence continuing North 51 degrees 12 minutes 24 seconds West 31.85 feet along said Line A; thence South 00 degrees 30 minutes 10 seconds west parallel with said east line of the Southeast Quarter of the Northwest Quarter a distance of 94.74 feet; thence South 89 degrees 29 minutes 50 seconds East 25.00 feet to the west line of said east 245.00 feet of the Southeast Quarter of the Northwest Quarter; thence North 00 degrees 30 minutes 10 seconds East 75.00 feet along said west line to the point of beginning. Together with that part of the East 245.00 feet of the Northeast Quarter of the Southwest Quarter of Section 20, Township 117, Range 21, Hennepin County, Minnesota, lying north of Excelsior Avenue. Conclusion 1. The proposed preliminary plat of Excelsior Townhomes is hereby approved and accepted by the City as being in accord and conformity with all ordinances, City plans and regulations of the City of St. Louis Park and the laws of the State of Minnesota, subject to the following conditions: a. A document ensuring that the flood plain storage will be provided in perpetuity to the benefit of the proposed development be executed and provided to the City for recording with the final plat. b. Hennepin County Department of Transportation shall provide final approval of the drainage layout within the proposed right-of-way expansion of Excelsior Boulevard and such layout shall include provision for pedestrian access along Excelsior Boulevard prior to final plat approval. c. The utility easements requested by Northern States Power around the perimeter of the proposed lots shall be included on the final plat. d. The proposed land exchange shall be recommended for approval by the Planning Commission and the Park and Recreation Board. e. The wetland mitigation plan shall be approved by the Minnehaha Creek Watershed District prior to final plat approval. f. The City will not consider any request for a conditional use permit until such time as the applicant provides evidence to the City that it has received all necessary State and Federal permits; including but not limited to approval from the Minnehaha Creek Watershed District. g. The City Attorney shall approve a document governing the land exchange. h. The school district boundaries shall be clarified.
