HomeMy WebLinkAbout93-182 - ADMIN Resolution - City Council - 1993/11/15RESOLUTION NO. 93-182 RESOLUTION CONVERTING A FINAL GENERAL PUD PLAN AND SPECIAL PERMITS TO PRELIMINARY AND FINAL PUD PLAN RELATING TO PROPERTY IN THE "0" OFFICE DISTRICT AT 300, 400 AND 600 HIGHWAY 169 AND 435 FORD ROAD FINDINGS WHEREAS, Section 14:6-7.6 of the Zoning Ordinance provides for the conversion of Final General PUD Plan and special permits which were approved under provisions of the previous Zoning Ordinance to either Preliminary or Final PUD Plan under the provisions of the current Zoning Ordinance; and WHEREAS, Section 14:6-7.6 of the Zoning Ordinance states that a Final General PUD Plan approved under the previous ordinance shall be equivalent to a Preliminary PUD Plan as described in Section 14:6-7.5.0 of the current ordinance and a special permit approved under the previous ordinance shall be equivalent to a Final PUD Plan as described in Section 14:6-7.5.D of the current ordinance; and WHEREAS, non -conformities in properties approved for conversion other than non- conforming land uses shall be deemed to be in compliance with Section 14:6-7.4 of the Zoning Ordinance and shall not be subject to the provisions of Section 14:7-1.0 of the Zoning Ordinance; and WHEREAS, the Planning Commission has reviewed the request for conversion of a Final General PUD Plan and special permits (Planning Case No. 93-43-ZA) and has recommended approval of the conversion with conditions; and WHEREAS the provisions of Resolutions numbered 86-168, 89-19 and 92-88 approving special permits under provisions of the previous Zoning Ordinance except portions relating to the 19 -story office building, and that part of the Final General PUD Plan approved by Ordinance No. 1686-68 under the previous Ordinance relating to the 19 - story office building, were in full force and effect on December 31, 1992 were therefore eligible for conversion under the appropriate provisions of this ordinance; NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park as follows: 1. Special permits approved by resolutions numbered 86-168, 89-19 and 92-88 as approved under provisions of the previous Zoning Ordinance are hereby converted to Final PUD plans pursuant to Section 14:6-7.6.B of the Zoning Ordinance. 2. That portion of the Final General PUD Plan approved by Ordinance No. 1686-86 under provisions the previous Zoning Ordinance relating to the 19 -story office tower is hereby converted to a Preliminary PUD Plan under the provisions of Section 14:6- 7.6.B of the Zoning Ordinance Subsequent development of the 19 -story office building shall require submission of an application for Final PUD approval pursuant to Section 14:6-7.5.D of the Zoning Ordinance. The City reserves the right to require, at its sole discretion, a traffic study to be conducted by the applicant or other parties in interest as part of the application for a Final PUD plan for the 19 -story office building. 4. The plans for the modification of Ford Road and Shelard Parkway as contained in Roadway Improvement Project 85-32 and Signal Improvement Project 87-28 and accepted by the City Council in Resolution Number 92-41 accepting the Engineer's report and setting public hearing are hereby acknowledged and incorporated as part of the PUD conversion to the extent that such modifications have a material effect on the subject property. Any conditions arising from the construction of the Ford Road improvement and associated right-of-way acquisition including but not limited to bufferyards and off-street parking shall be deemed to be in compliance with the Zoning Ordinance and shall not constitute a non -conformity.
