HomeMy WebLinkAbout93-134 - ADMIN Resolution - City Council - 1993/09/07i RESOLUTION NO. 93-134 RESOLUTION COMMITTING TO FUND AND CONSTRUCT ROADWAY IMPROVEMENTS FOR TOWER PLACE PROJECT PRIOR TO OCCUPANCY PURSUANT TO INDIRECT SOURCE PERMIT APPLICATION WHEREAS, an Indirect Source Permit application was submitted for the Tower Place development to the Minnesota Pollution Control Agency (PCA) by Park Nicollet Medical Center and Frauenshuh Companies in June of 1993; and WHEREAS the application indicates that a number of changes to the existing roadway system are required to accommodate the existing traffic, other traffic growth and the proposed Tower Place development; and WHEREAS the PCA has indicated that a legally binding commitment for installation of the roadway improvements is required before the Indirect Source Permit application can be processed further; and WHEREAS committing to the installation of the roadway improvements does not preclude the City from passing on a part of the cost of installing the required Phase I and Phase II roadway improvements to Park Nicollet Medical Center, Frauenshuh Companies or other parties; and WHEREAS, Park Nicollet Medical Center and Frauenshuh Companies have committed to the City to contribute, at a minimum, $135,000 towards off-site roadway improvements; and WHEREAS the City has identified Tax Increment Financing and State Aid as the source of funds to pay for the City's share of the cost of required Phase I roadway improvements; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Louis Park hereby commits to funding the Phase I roadway improvements set forth in the Indirect Source Permit application dated June 16, 1993 such that the improvements will be completed prior to occupancy of Phase I of the project and to funding Phase II roadway improvements as set forth in the Indirect Source Permit application dated June 16, 1993 such that the improvements will be completed prior to occupancy of Phase II according to the schedule set forth in the Indirect Source Permit application.
