HomeMy WebLinkAbout93-102 - ADMIN Resolution - City Council - 1993/07/19RESOLUTION NO. 93-102 RESOLUTION AUTHORIZING PURCHASE OF LAND LOCATED AT 9258 CLUB ROAD WHEREAS, the City of St. Louis Park has determined it is in its best interests to extend Cedar Manor Park for public purposes; and WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with Rick Bateson, acting on behalf of the property owner Harold Aretz, for the purchase of fee title to the land hereinafter described; and WHEREAS, pursuant to such negotiations, Harold Aretz desires to sell said property to the City by General Warranty Deed for the sum of $78,000, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis Park that the City of St. Louis Park purchase the following -described property in Hennepin County, Minnesota, from Harold Aretz: (See legal description attached - Exhibit A) and that the Mayor and City Manager are hereby authorized to execute any and all instruments necessary to complete the purchase of said property, and the City Manager is hereby authorized and directed to accept delivery of the deeds and pay the sum of $78,000 to Harold Aretz upon delivery by the seller of a General Warranty Deed to said property accompanied by an Abstract of Title or Owner's Certificate of Title showing good and marketable title of record to said property, together with an opinion of the City Attorney of the City of St. Louis Park approving, the execution of the Deed and the seller's Abstract or Ce:=tificate. Attest: City C er Adopted by the City Council July 19, 199 Reviewed for Administration: yor Approved as to form and execution: a¢ortt.uaii flue City Attorney EXHIBIT A - LEGAL DESCRIPTION That part of the Southwest 1/4 of the Northwest 1/4 and that part of the Northwest 1/4 of the Southwest 1/4 of Section 7, Township 117 North, Range 21 West of the 5th Principal Meridian, described as follows: That part lying South of Aretz 5th Addition and West of Aretz 4th Addition and West of Aretz 3rd Addition and North of a line drawn from the Northwest corner of Lot 4, Block 2, Aretz 3rd Addition to a point on the West line of said Northwest 1/4 of the Southwest 1/4 of Section 7, 221 feet South of the Northwest corner of the Northwest 1/4 of the Southwest 1/4; excepting therefrom the tract of land heretofore deeded to the City of St. Louis Park by Warranty Deed dated June 29, 1960, filed July 8, 1960 in Book 2261 of Deeds, page 418 and recorded as document number 3241191 for land therein described as follows: That part of the Southwest 1/4 of the Northwest 1/4 and that part of the Northwest 1/4 of the Southwest 1/4 of Section 7, Township 117, Range 21, described as follows: Beginning at the angle point in the Southerly line of Lot 2, Block 2, Aretz 5th Addition, said point being 40 feet Southeasterly of the Southeast corner of Lot 1, in said Block 2, Aretz 5th Addition; thence South parallel with the West line of said Section 7, 433 feet; thence Southeasterly deflecting to the left at an angle of 51 degrees a distance of 260 feet; thence Southeasterly deflecting to the right at an angle of 36 degrees a distance of 115 feet; thence Southerly deflecting to the right at an angle of 15 degrees to an intersection with a line drawn from the Northwest corner of Lot 4, Block 2, Aretz 3rd Addition to a point the West line of said Northwest 1/4 of the Southwest 1/4, distant 221 feet South of the Northwest corner thereof; thence East along said line so drawn to the Northwest corner of said Lot 4, Block 2, Aretz 3rd Addition; thence Northerly along the Westerly line of said Block 2, Aretz 3rd addition and Northwesterly and Northerly along the Westerly line of Block 2, Aretz 4th Addition to the Southerly line of Block 3, Aretz 5th Addition; thence Westerly along the Southerly line of Aretz 5th Addition to the point of beginning.
