HomeMy WebLinkAbout93-101 - ADMIN Resolution - City Council - 1993/07/19RESOLUTION NO, 93-101 A RESOLUTION RESCINDING RESOLUTION NO. 93-31 ADOPTED ON APRIL 19, 1993 AND GRANTING CONDITIONAL USE PERMIT UNDER SECTION 14:5-6.2(D) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A RESTAURANT WITH LIQUOR FOR PROPERTY ZONED "0" OFFICE DISTRICT LOCATED AT 5235 WAYZATA BOULEVARD FINDINGS WHEREAS, MEPC American Properties, Inc. (General Mills Restaurants, Inc.) has made application to the City Council for a conditional use permit under Section 14:5-6.2(D) of the St. Louis Park Ordinance Code to allow minor modifications for a restaurant at 5235 Wayzata Boulevard within an "0" Office District having the following legal description: Tract B, Registered Land Survey No. 864, except the west 175.00 feet thereof (Torrens Certificate No. 764164) WHEREAS, the City Council has considered the information related to Planning Case Nos. 93 -9 -CUP and 93 -34 -CUP and the effect of the proposed minor modifications to a restaurant on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a conditional use permit was issued regarding the subject property pursuant to Resolution No. 93-31 of the St. Louis Park City Council dated April 19, 1993 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that conditional use permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 93-31 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Case Files 93 -9 -CUP and 93 -34 -CUP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 93-31 filed as Document No. 2369687 is hereby rescinded and replaced by this resolution which continues and amends a conditional use permit to the subject property for the purposes of permitting a restaurant with liquor within the "0" Office District at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan; Exhibit B - Utility Plan, as modified to relocate the fire hydrant at the southwest corner approximately 40 feet to the east; Exhibit C - Landscape,Plan and Exhibit D - Exterior Elevations; such documents incorporated by reference herem. (Exhibit A and Exhibit C are replaced by Exhibit A-1, Site Plan and Exhibit C-1, Landscape Plan; see Condition No. 3.a) 2. All improvement shall be completed prior to issuance of a Certificate Of Occupancy. 3. The conditional use permit shall be amended pursuant to Planning Case No. 93 -34 - CUP to permit moving the curb line on Utica Avenue, modification of the landscaping in the front yard, modification to the parking layout and modification to the drainage plan subject to the following conditions: a. Exhibit A, Site Plan and Exhibit C, Landscape Plan are replaced by Exhibit A- 1, Site Plan and Exhibit C-1, Landscape Plan.
