HomeMy WebLinkAbout92-70 - ADMIN Resolution - City Council - 1992/05/18RESOLUTION NO. 92-70 A RESOLUTION RESCINDING RESOLUTION NO. 6916 ADOPTED ON AUGUST 3, 1981 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-124(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW ADDITIONAL PARKING FOR THE PARK NATIONAL BANK AT 5353 WAYZATA BOULEVARD FINDINGS WHEREAS, Claude N. Rosenberg, Jr., Paul Sack, Alander F. Hogland, Johnson S. Bogart, Richard J. Bertero, Donald A. King, Jr., Orra C. Hyde, III, John N. Dayton and Gerald E. Egan, and their successors in trust, as Trustees of RREEF Mid-America Fund III; and the City of St. Louis Park have made application to the City Council for a special permit under Section 14-124(2) of the St. Louis Park Ordinance Code to allow construction of an additional parking area for the Park National Bank at 5353 Wayzata Boulevard within a DDD, Diversified Development District having the following legal description: See Attached Exhibit A - Legal Description WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission Case Nos. 78 -73 -DDD and 92 -27 -SP and the effect of the proposed construction of an additional parking area for the Park National Bank. on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 6916 of the St. Louis Park City Council dated August 3, 1981 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 6916 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Commission Case Files 78 -73 -DDD and 92 -27 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 6916 (Document not filed) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting construction of an additional parking area for the Park National Bank within the DDD, Diversified Development District at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan, Exhibit B - Elevation Plans and Exhibit C - Landscape Plan. Plans, which are acceptable to the City, for the supplemental watering system or irrigation system to serve the landscape areas must be submitted prior to December 30, 1978. (Exhibits A and C are modified by Exhibits D and F in Condition No. 5) 2. All improvements, including building construction, landscaping, curbing, paving, parking lot striping, and lighting shall be completed by October 1, 1979. 3. Permit is conditioned on the applicant and the City completing the acquisition of right-of-way for the detachment of the frontage road prior to issuance of a construction permit. 4. Landscaping shall be provided in accordance with the revised landscape plan labeled Exhibit C-1, Landscape Plan. 5. The site, including the additional parking area (Case No. 92 -27 -SP), shall be developed, used and maintained in accordance with Exhibit D - Site Plan, Exhibit E - Grading and Utility Plan and Exhibit F - Landscape Plan; such documents incorporated by reference herein. (Modifies Condition No. 1) 6. All improvements shall be completed prior to issuance of a Certificate of Occupancy.
