HomeMy WebLinkAbout92-69 - ADMIN Resolution - City Council - 1992/05/18RESOLUTION NO. 9 2 - 6 9 A RESOLUTION RESCINDING RESOLUTION NO. 6259 ADOPTED ON May 7, 1979 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-124.101(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW CONSTRUCTION OF A 26,000 SQUARE FOOT POLICE FACILITY AT 5005 MINNETONKA BOULEVARD FINDINGS WHEREAS, The City of St. Louis Park has made application to the City Council for a special permit under Section 14-124.101(2) of the St. Louis Park Ordinance Code to allow the construction of a 26,000 square foot police facility at 5005 Minnetonka Boulevard within a PUD, Planned Unit Development District having the following legal description: See Attached Exhibit A - Legal Description WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission Case Nos. 79 -27 -SP and 92 -17 -SP and the effect of the proposed construction of a 26,000 square foot police facility on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 6259 of the St. Louis Park City Council dated May 7, 1979 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 6259 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Commission Case Files 79 -27 -SP and 92 -17 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 6259 (Document not filed) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting the construction of a 26,000 square foot police facility within the PUD, Planned Unit Development District at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan and Exhibit B - Elevation Plan. (Exhibit A modified by Exhibit C in Condition No. 4) 2. That the rooftop equipment on the top of City Hall be property screened. 3. That the construction, including landscaping, access and other elements of the plan, be completed by October 15, 1980. 4. The site, including the police facility (Case No. 92 -17 -SP), shall be developed, used and maintained in accordance with Exhibit C - Site Plan, Exhibit D - Landscape Plan and Exhibit E - Elevations; such documents incorporated by reference herein. (Exhibit C modifies Exhibit A of Condition No. 1) 5. All site lighting developed in conjunction with the police facility shall be installed so that no light source is directly visible from adjacent properties. 6. That all improvements shall be completed prior to issuance of a Certificate of Occupancy.
