HomeMy WebLinkAbout92-56 - ADMIN Resolution - City Council - 1992/05/041 1 RESOLUTION NO. 9 2 - 5 6 A RESOLUTION RESCINDING RESOLUTION NO. 6859 ADOPTED ON JUNE 1, 1981 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-141(3) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW ADDITIONAL PARKING STALLS FOR A NURSING HOME AT 3201 VIRGINIA AVENUE SOUTH FINDINGS WHEREAS, Beverly Enterprises - Minnesota, Inc. has made application to the City Council for a special permit under Section 14-141(3) of the St. Louis Park Ordinance Code to allow additional parking stalls for a nursing home at 3201 Virginia Avenue South within a R-4, Multiple Family Residential District having the following legal description: Lot 1, Block 1, Aquila Park Addition (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Case Nos. 81 -49 -SP and 92 -23 -SP and the effect of the proposed additional parking stalls for a nursing home on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, the City Council fords that installation of the additional parking stalls will have little or no effect on neighboring property and the general public and will have some positive effect by reducing the amount of on -street parking that occurs, and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 6859 of the St. Louis Park City Council dated June 1, 1981 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 6859 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Commission Case Files 81 -49 -SP and 92 -23 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 6859 (Document not filed) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting additional parking stalls for a nursing home within the R-4, Multiple Family Residence District at the location described above based on the following conditions: 1. That the structure be built as shown on Exhibit "H" 2. That Exhibit "D", Planting Schedule, from Resolution 2562 become part of this permit and that the planting take place in accordance with it. 3. That no tree required by the Planting Plan, Exhibit "D", shall be less than two (2) inches in diameter, one foot from the ground, and shall be no less that fifteen (15) feet tall. 4. That all outdoor illumination shall be accomplished in such a manner that no direct rays shall penetrate beyond the property line nor be visible from any residential section or public right of way. 5. Prior to issuance of any building permit under this special permit, the applicants shall provide the City with a certified copy of a document, recorded with the Recorder of Deeds, showing that Lot 3, Block 1, Aquila Park Addition is restricted in building density, said document to show the use of Lot 3 in calculating density on Lot 1. Said document shall be subject to the approval of the City Attorney. 6. The bank behind the homes along the west side of the 3200 block of Texas Avenue, owned by the applicants, shall be sodded or seeded in such a manner as to prevent erosion of the bank. 7. A garage (accessory structure) containing no more than 576 square feet is allowed at the northeast corner of the property with the following conditions: a. The garage shall be set back eighteen (18) feet from the rear lot line and forth -two (42) feet from the side lot line. 8. An additional 17 parking stalls are permitted as shown on Exhibit I - Additional Parking Plan as modified to eliminate the most westerly stall located in the courtyard area. The additional parking stalls shall be completed by May 1, 1993.
