RESOLUTION NO. 92-196
A RESOLUTION RESCINDING RESOLUTION NO. 90-133 ADOPTED ON
SEPTEMBER 17, 1990 AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTIONS 14-156(15) AND 14-150(3)(a) OF THE ST.
LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW
CHANGE IN HOURS OF OPERATION TO 24 HOURS A DAY, 7 DAYS A
WEEK AT 5900 EXCELSIOR BOULEVARD
FINDINGS
WHEREAS, Super America Group, Inc. has made application to the City Council for a
special permit under Sections 14-156(15) and 14-150(3)(a) of the St. Louis Park Ordinance
Code to allow change in hours of operation to 24 hours a day, 7 days a week, at 5900
Excelsior Boulevard within a B-2, General Business District having the following legal
description:
Lots 1 and 2, Block 5 "Meadowbrook Addition" (Torrens Certificate No.
562700)
WHEREAS, the City Council has considered the information related to Planning
Case Nos. 77 -86 -SP, 90 -60 -SP and 92 -61 -SP and the effect of the proposed change in hours of
operation on the health, safety, and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 90-133 of the St. Louis Park City Council dated September 17, 1990 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 90-133 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Case Files 77 -86 -SP, 90 -60 -SP and 92 -61 -SP
are hereby entered into and made part of the public hearing record and the record of
decision for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 90-133 filed as
Document No. 2126728 is hereby rescinded and replaced by this resolution which continues
and amends a special permit to the subject property for the purposes of permitting a change
in hours of operation within the B-2, General Business District at the location described
above based on the following conditions:
1. The site shall be developed, used, and maintained in accordance with Exhibit A, Site
Plan/Landscape Plan; Exhibit B, Elevation Plan; Exhibit C, Sign Plan; Exhibit D,
Canopy and Pump Island Plan; and Exhibit F, Light Standard Plan, except as
modified by the following. (Exhibit B rescinded - See Condition No. 10)
2. The total sign area of the site be reduced to a maximum sign area of 300 square feet.
The free standing sign shall be limited to 20 feet in height and shall not contain more
than 84 square feet per side and no more than 168 square feet of total sign area.
3. An interior access shall be provided for an employee restroom.
4. An emergency egress shall be provided from the sales area at the west side of the
building.
5. A 12 foot easement shall be provided for pedestrian purposes prior to the issuance of
the building permit.
6. The hours of allowed operation shall be limited to the time period from 6:00 a.m. to
12:00 midnight (Condition deleted - See Condition No. 12)
7. Applicant concurs in the establishment of a median on Excelsior Boulevard with
access being provided at Zarthan Avenue.
8. Restrooms for men and women shall be provided with access only from the interior of
the building.
9. All site improvements, including building construction pump islands and canopy
construction, refuse enclosure, landscaping and parking lot striping and paving shall
be completed by September 1, 1978.
10. That Exhibit B in Condition No. 1 be replaced by Exhibit B1.
11. That site improvements set forth under condition No. 10 be completed by September
17, 1991.
12. The special permit shall be amended pursuant to Planning Case No. 92 -61 -SP to
permit change in hours of operation to 24 hours a day, 7 days a week.
a. Condition No. 6 is deleted.
