A RESOLUTION RESCINDING RESOLUTION NO. 87-82 ADOPTED ON
JULY 6, 1987, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTIONS 14-124.101 AND 14-123.100(2) OF THE ST. LOUIS
PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A SOIL
REMEDIATION STUDY FACILITY AT 3500 LOUISIANA AVENUE
FINDINGS
WHEREAS, St. Louis Park Economic Development Authority has made application
to the City Council for a special permit under Sections 14-124.101 and 14-123.100(2) of the
St. Louis Park Ordinance Code to allow a soil remediation study facility at 3500 Louisiana
Avenue within a PUD, Planned Unit Development District having the following legal
description:
Portion of Lot 1, Block 5, Oak Park Village (Abstract)
WHEREAS, the City Council has considered the information related to Planning
Case Nos. 87 -46 -SP and 92 -58 -SP and the effect of the proposed soil remediation study
facility on the health, safety, and welfare of the occupants of the surrounding lands, existing
and anticipated traffic conditions, the effect on values of properties in the surrounding area
and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 87-82 of the St. Louis Park City Council dated July 6, 1987 which contained
conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 87-82 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Case Files 87 -46 -SP and 92 -58 -SP are hereby
entered into and made part of the public hearing record and the record of decision for this
case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 87-82 filed as Document
No. 5304752 is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting a soil
remediation study facility within the PUD, Planned Unit Development District at the
location described above based on the following conditions:
1. That the sites, each measuring approximately 12 feet by 12 feet, be developed, used
and maintained for two well houses in accordance with Exhibit A - Site Plan; Exhibit
B - Planting Plan; and Exhibit C - Elevation, modified to show the electrical conduit
and meter inside the building, subject to the following.
a. All utilities servicing the structures shall be placed underground.
b. No outdoor storage of any hazardous or non -hazardous materials is allowed.
c. The exterior of the well house buildings shall be brick with footings designed
to accommodate additional brick or masonry exteriors to obtain a match with
the buildings proposed elsewhere on the property.
d. The well house buildings shall be insulated to reduce the impact of noise on
the residential neighborhood.
e. All improvements including landscaping shall be completed by May 15, 1988.
2. The special permit shall be amended pursuant to Planning Case No. 92 -58 -SP to
permit a soil remediation study facility subject to the following conditions:
a. The site shall be developed, used and maintained in accordance with Exhibit D
- Proposed Locations for Bioventing Demonstration Plots such documents
incorporated by reference herein.
b. The study area site shall be enclosed by an opaque wooden fence 6 feet in
height.
c. The applicant shall work with the City to secure an earth tone colored trailer,
low in height, for the study.
d. That all fencing, piping and structures be removed from the site within 30
days of conclusion of the tests or by December 30, 1995, whichever comes
earlier.
