RESOLUTION NO. 92-138
A RESOLUTION RESCINDING RESOLUTION NO. 86-35 ADOPTED ON
MARCH 17, 1986 AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-123.100(2) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO ALLOW
MODIFICATIONS TO AN EXISTING OFFICE BUILDING AT 2460
HIGHWAY 100
FINDINGS
WHEREAS, Knighton Real Estate Company has made application to the City Council
for a special permit under Section 14-123.100(2) of the St. Louis Park Ordinance Code to
allow modifications to an existing medical office building at 2460 Highway 100 within the R-
B, Residential Business, and F-2, Floodplain, Districts having the following legal description:

WHEREAS, the City Council has considered the information related to Planning
Case Nos. 86 -7 -SP and 92 -46 -SP and the effect of the proposed modifications to the existing
building on the health, safety, and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 86-35 of the St. Louis Park City Council dated March 17, 1986 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 86-35 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Case Files 86 -7 -SP and 92 -46 -SP are hereby
entered into and made part of the public hearing record and the record of decision for this
case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 86-35 filed as Document
No. 5095198 is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting modifications
to the existing medical office building within the R -B, Residential Business, and F-2,
Floodplain Districts at the location described above based on the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - Site
Plan and Exhibit B - Site Plan showing grading and drainage. (Exhibit A replaced
with Exhibit A-1, see condition 7a.)
2. The parking lot curbing shall extend 6 inches above and below grade and be poured in
place concrete.
3. Any structure on the lot shall be constructed such that the lowest floor elevation is at
or above elevation 880.4 feet, NGVD, (170.1 feet, City Datum).
4. The owner and applicant hereby recognize that future area -wide drainage
improvements are contemplated and that this property is affected by these proposed
improvements. The applicant shall submit plans for approval by the City Engineer
which show how the subject property will be connected to the storm sewer
improvement. Said plans shall be submitted to the City no later than 30 days
following approval of final plans for the storm sewer improvement by the City
Council. The owner or applicant will have four months to modify their site drainage
to comply with the City's storm water system, the four months to commence on the
date the City Engineer approves the applicant's plans. (Repealed by Condition 7b
below)
5. That all outdoor lighting shall be no higher than 25 feet and be directed
perpendicular to the ground so no direct rays extend beyond the property.
6. All improvements, with the exception of the drainage modifications referred to in
Condition 4 above, shall be completed by May 15, 1987.
7. The special permit shall be amended pursuant to Planning Case No. 92 -46 -SP to
permit modifications to an existing office building subject to the following conditions:
a. The site shall be developed, used and maintained in accordance with Exhibit
A-1 - Site Plan and Exhibit B - Skimmer, such document incorporated by
reference herein.
. b. Condition 4 above is hereby repealed.
c. The garage addition shall be constructed of materials similar to those of the
existing building.
d. All improvements shall be completed prior to issuance of a Certificate of
Occupancy.

LEGAL DESCRIPTION
Lot 4, Block 1, Ridge Addition, according to the recorded plat
thereof, and situated in Hennepin County, Minnesota.
together with an easement for ingress and egress purposes over the
following described parcel of property:
That part of Lot 3, Block 1, RIDGE ADDITION, Hennepin County,
Minnesota, described as follows:
Beginning at the southwest corner of Lot 4, Block 1,
RIDGE ADDITION; thence Southerly along the southerly
extension 'of the west line of said Lot 4, to an
intersection with a line 22 feet southwesterly of,
measured at a right angle to and parallel with the
southwesterly line of said Lot 4; thence Southeasterly
along said parallel line to the easterly line of said Lot
3, thence Northerly along the easterly line of said Lot
3 to the most southerly corner of said Lot 4; thence
Northwesterly along the southwesterly line of said Lot 4
to the point of beginning.
