RESOLUTION GRANTING PRELIMINARY APPROVAL OF A BUILDING
PERMIT DENIED BY THE INSPECTIONS DIVISION
- 27 WEST BUSINESS CENTER (7600 W. 27TH STREET)
WHEREAS, the Inspections Division of the City of St. Louis Park has
received a building permit application from Smith Architects for the
construction of 27 West Business Center at 7600 W. 27th Street; and
WHEREAS, a review of construction plans submitted in conjunction with the
building permit indicates the applicant will construct the project at 27 West
Business Center in two phases; and
WHEREAS, the proposed phased construction of 27 West Business Center
entails termination of Phase One construction at a common wall between the two
construction phases; and
WHEREAS, a review of the phased construction plan for 27 West Business
Center by the Director of Public Works indicates the common wall will serve as
an exterior wall between the time of Phase One completion and Phase Two
construction of 27 West Business Center; and
WHEREAS, the Director of Public Works has determined that the
construction plans for 27 West Business Center do not provide for the use of
building exterior treatment materials on the face of the common wall (which
will serve as a temporary exterior wall between Phase One and Phase Two
construction) that comply with City Ordinance Section 15-222; and
WHEREAS, pursuant to City Ordinance Section 15-224 the City Council is
authorized to provide preliminary approval of a building permit in cases where
City Ordinance Section 15-222 prohibits such action by the Inspections Division
if the applicant submits a request for preliminary approval to the City
Council.
WHEREAS, Smith Architects, upon receipt of notice that the referenced
building permit application cannot be approved by the Inspections Division
because the exterior wall treatment of the common wall technically violates
City Ordinance Section 15-222, has requested the City Council provide
preliminary approval of the building permit application pursuant to City
Ordinance Section 15-224; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St.
Louis Park, Minnesota that pursuant to City Ordinance Section 15-224, the Smith
Architects' request for preliminary building permit approval relative to the
exterior treatment of the west wall of Phase One, 27 West Business Center (7600
W. 27th Street) is hereby granted with the following conditions imposed:

1. Phase Two of the project known as 27 West Business Center must be
constructed within four years of the issuance of the building
permit for Phase One, or in the event Phase Two is not constructed
within the time prescribed herein, the exterior face of the west
wall of said Phase One must be treated with exterior treatment
materials conforming to applicable City Ordinance requirements
within the same four year period.
2. If the property owner fails to comply with condition no. 1, the
City will withhold approval of all building permit applications for
the expansion of Phase One 27 West Business Center or will withhold
all Certificates of Occupancy for all office -warehouse facilities
of said Phase One using said west wall as a facility wall until
such time as Phase Two is constructed or treatment materials
conforming to applicable City Ordinances are placed on the exterior
of said west wall.
3. Preliminary building permit approval granted relative to the
exterior of said west wall of said Phase One 27 West Business
Center shall not be construed to be applicable to any other portion
or segment of the building permit approval process which shall
remain the sole responsibility of the Inspections Division, and
that said preliminary building permit approval granted relative to
the exterior of said west wall of said phase one shall not
constitute approval of any other element of the plans and/or
specifications submitted in support of the building permit
application.
