A RESOLUTION RESCINDING RESOLUTION NO. 88-81 ADOPTED ON
JULY 18, 1988 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTION 14-123.100(2) OF THE ST. LOUIS PARK ORDINANCE
CODE RELATING TO ZONING TO ALLOW A BUILDING ADDITION IN A
FLOODPLAIN FOR PROPERTY ZONED I-1, INDUSTRIAL DISTRICT, AND
F-2, FLODPLAIN DISTRICT, AT 6999-7009 OXFORD STREET
FINDINGS
WHEREAS, Jack B. Anderberg (Anderberg-Lund Investments) has made application to
the City Council for a special permit under Section 14-123.100(2) of the St. Louis Park
Ordinance Code to allow a building addition at 6999-7009 Oxford Street within the I-1,
Industrial District, and F-2, Floodplain District having the following legal description:
Tract A, Registered Land Survey No. 1623, Files of Registrar of Titles, County
of Hennepin (Torrens Certificate No. 726782)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission Case Nos. 88 -54 -SP and 91 -11 -SP and the effect of the proposed
building addition on the health, safety, and welfare of the occupants of the surrounding
lands, existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 88-81 of the St. Louis Park City Council dated July 18, 1988 which contained
conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions of the
permit granted by Resolution No. 88-81 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Commission Case Files 88 -54 -SP and 91 -11 -SP are
hereby entered into and made part of the public hearing record and the record of decision
for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 88-81 filed as Document No.
1945850 is hereby rescinded and replaced by this resolution which continues and amends a
special permit to the subject property for the purposes of permitting a building addition
within the I-1, Industrial District, and F-2 Floodplain District at the location described above
based on the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit
A - Site Plan,and Exhibit B - Elevations, such documents incorporated by
reference herein.
2. The asphalt on the City property bordering the south side of the site shall be
removed and the area shall be sodded. (Condition 2 replaced with Exhibit C
below)
3. The lowest floor elevation of any structure shall be at or above elevation 895.0
NGVD (187.7 feet City Datum).
4. All improvements in conditions 1-3 shall be completed by October 31, 1989.
5. Condition No. 2 above is hereby deleted and replaced with the following:
The asphalt on the City property bordering the south side of the site shall be
removed to the extent shown on Exhibit C, Amendment to the Site plan. The
remainder of the asphalt may remain in place and property owner may make
use of this portion of the City property for vehicular access use, subject to the
execution of an agreement between the City and the property owner
regarding the use of the City property.

On September 8, 2005, Commercial Partners obtained City certified copies of the
documents enclosed. The documents were submitted to the Torrens recording office for
filing but were not accepted and required approval from the torrens examiner before
recording. Prior to returning the documents the torrens office unstapled the certified
copies. The county Examiner will not review the documents until we obtain new certified
copies from the City without the staples being removed. Please return to me in the
envelope enclosed new City certified copies of the enclosed documents.
