A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTIONS 14-123.100(2), 14-156(18) AND 14-171(3) OF THE ST.
LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT
CONSTRUCTION OF A VEHICLE EMISSIONS TESTING STATION FOR
PROPERTY ZONED I-1, INDUSTRIAL DISTRICT AND F-2, FLOODPLAIN
DISTRICT, LOCATED AT 3985 MEADOWBROOK ROAD
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Salkin and Linoff (Systems Control) has made application to the City Council for a
special permit under Sections 14-123.100, 14-156(18) and 14-171(3) of the St. Louis Park
Ordinance Code for the purpose of permitting the construction of a vehicle emissions
testing station within the I-1, Industrial District, and F-2, Floodplain District, located at
3985 Meadowbrook Road for the legal description as follows, to -wit:
That part of the Southeast Quarter of the Northwest Quarter of Section 20,
Township 117, Range 21, Hennepin County, Minnesota, described as
beginning at a point on the west line of said Southeast Quarter of the
Northwest Quarter of Section 20 distant 288.80 feet north of the southwest
corner of said Southeast Quarter of the Northwest Quarter of Section 20;
thence South 0 degrees 15 minutes 47 seconds West, assumed bearing, along
said west line of the Southeast Quarter of the Northwest Quarter of Section
20, a distance of 235.18 feet; thence South 89 degrees 58 minutes 30 seconds
East a distance of 606.53 feet; thence North 0 degrees 24 minutes 00 seconds
West a distance of 232.68 feet to a line which bears South 89 degrees 44
minutes 13 seconds East from the point of beginning; thence North 89
degrees 44 minutes 13 seconds West a distance of 603.83 feet to the point of
beginning. (Abstract)
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 91 -4 -SP) and the effect of the proposed vehicle emissions testing
station on the health, safety and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area, the effect of the use on the Comprehensive Plan, and compliance with
the intent of the Zoning Ordinance.
3. The Council has determined that the vehicle emissions testing station will not be
detrimental to the health, safety, or general welfare of the community nor will it cause
serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property
values, and the proposed vehicle emissions testing station is in harmony with the general
purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
4. The contents of Planning Case File 91 -4 -SP are hereby entered into and made part of
the public hearing record and the record of decision for this case.
Conclusion
The special permit to permit the construction of a vehicle emissions testing station at the
location described is granted based on the findings set forth above and subject to the
following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A
- Site Plan, Exhibit B - Grading and Utility Plan and Exhibit C - Landscape
Plan and Exterior Elevations, such documents incorporated by reference
herein.
2. This special permit shall not be effective until the parcel division which
creates the parcel on which the vehicle emission testing station is to be
located is recorded with Hennepin County.
3. All improvements shall be completed prior to the issuance of a Certificate of
Occupancy.
