RESOLUTION NO.qi 91-3
A RESOLUTION RESCINDING RESOLUTION NO. 6854 ADOPTED ON
JUNE 1, 1981, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTION 14-156(15) OF THE ST. LOUIS PARK ORDINANCE
CODE RELATING TO ZONING TO ALLOW A MOTOR FUEL STATION
AND HOLIDAY STATIONSTORE FOR PROPERTY LOCATED IN THE B-2,
BUSINESS DISTRICT, AT 5720 EXCELSIOR BOULEVARD
FINDINGS
WHEREAS, Holiday Stationstores, Inc. has made application to the City Council for a
special permit under Section 14-156(15) of the St. Louis Park Ordinance Code to allow a
motor fuel station and Holiday Stationstore at 5720 Excelsior Boulevard within a B-2,
Business District, having the following legal description:
Lots 19 and 20 and South 40 feet of Lot 21, Block 2, Meadowbrook Addition
(Abstract)
WHEREAS, the City Council has considered the information in the file for Case No. 90-
84 -SP and the effect of the proposed motor fuel station and Holiday Stationstore on the
health, safety, and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area and
the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 6854 of the St. Louis Park City Council dated June 1, 1981 which contained
conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions of
the permit granted by Resolution No. 6854 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Case File 90 -84 -SP are hereby entered into and made part of
the public hearing record and the record of decision for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 6854 (Document not
filed) is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting a
motor fuel station and Holiday Stationstore within the B-2, Business District, at
the location described above based on the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit
A, Site Plan, as modified by the City Engineer for drainage; Exhibit B,
Building Elevations dated December 5, 1990; and Exhibit C, Site Details, such
documents incorporated by reference herein.
2. That there be no outdoor storage of trash and that all trash not stored in the
building be stored in the trash enclosure as provided for on Exhibit A and that
there be no other outdoor storage on the property.
3. All outdoor lighting be directed perpendicular to the ground, and no direct
rays shall be allowed to penetrate beyond the property line.
4. Prior to issuance of a building permit, a sidewalk easement shall be provided
to the City along Excelsior Boulevard. Said easement shall be a minimum of
five feet. The easement area granted shall be counted as part of the required
setback area.
5. All curbing shown on the Site Plan shall be poured in place concrete.
6. All improvement including building, trash enclosure, landscaping, parking
striping and other items shown on the exhibits shall be completed by
December 31, 1991.
