HomeMy WebLinkAbout91-22 - ADMIN Resolution - City Council - 1991/01/22RESOLUTION NO. 91-22 Resolution Establishing a Severance Pay Policy for Certain Employees Laid Off Due to Economic Conditions Whereas, the City Council believes it is in the best interests of the City to provide severance pay for eligible employees laid off due to economic conditions; and Whereas, the severance pay policy for laid off employees is designed to provide short-term economic assistance to the former employee, - Now, therefore, be it resolved by the City Council of the City of St. Louis Park that: 1. A severance pay policy for certain employees laid off due to economic conditions is hereby established; 2. Eligibility shall be limited to regular (non -probationary), non-union, full time or part time employees, appointed or otherwise, who are laid off according to the terms of Section 3.206, Layoffs, of the Personnel Ordinance, and whose lay off was not the result of poor job performance or misconduct as determined- by the City Manager, and whose lay off was effected after December 30, 1990. 3. Severance pay shall be based on one (1) week's pay for each full year of employment with a minimum of one (1) week's pay and a maximum of five (5) weeks pay. This shall be calculated at the employee's hourly rate of pay at the time of lay off and shall be based upon the time period the employee was eligible as identified in paragraph 2 above. Payment shall be in one lump sum. 4. Severance pay to an eligible employee is conditioned upon the eligible employee executing a release of any and all claims or liabilities the employee may have against the City which will be provided to the employee by the City. Severance pay shall not be received until after the recission period for such release contained in applicable state or federal laws. 5. This provision shall not exclude an employee eligible for benefits provided in Section 3.602(e), Severance. This severance pay policy is intended to be in addition to 3.602(e), Severance, of the City's Personnel Ordinance. 6. The City Manager shall have the authority to execute and implement this policy.
