A RESOLUTION RESCINDING RESOLUTION NO. 90-143 ADOPTED ON
OCTOBER 1, 1990 AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-123.100(2) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO ALLOW
CONSTRUCTION OF AN ADDITION TO THE EXISTING CHURCH
BUILDING CONSISTING OF A CLASSROOM AND FELLOWSHIP HALL IN
THE R-1, SINGLE FAMILY RESIDENCE DISTRICT, AND F-2,
FLOODPLAIN DISTRICT; AT 1615 TEXAS AVENUE.
FINDINGS
WHEREAS, Park Assembly of God has made application to the City Council for a special
permit under Section 143.100(2) of the St. Louis Park Ordinance Code to allow
construction of an addition to the existing church building consisting of a classroom and
fellowship hall at 1615 Texas Avenue within the R-1, Single Family, and F-2, Floodplain
Districts; and
WHEREAS, the incorrect legal description was used in Resolution No. 90-143; and
WHEREAS, the legal description of the property at 1615 Texas Avenue is set forth
on Attachment A; and
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission Case No. 79 -91 -SP and 90 -62 -SP and the effect of the proposed
construction of an addition to the existing church building consisting of a classroom and
fellowship hall on the health, safety, and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 90-143 of the St. Louis Park City Council dated October 1, 1990 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions of
the permit granted by Resolution No. 90-143 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Commission Case File 79 -91 -SP and 90 -62 -SP are
hereby entered into and made part of the public hearing record and the record of decision
for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 90-143 filed as Document
No. 5708654 is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting construction
of an addition to the existing church building consisting of a classroom and fellowship hall
within the R-1, Single Family Residence, and F-2, Floodplain Districts at the location
described above based on the following conditions:
1. The parking lot, drainage facilities, landscaping and other improvements shall
be constructed and maintained in accordance with Exhibit A - Site Plan, Phase
I; Exhibit B - Grading and Drainage Plan; Exhibit C - Cross Sections; Exhibit D
- Site Details and Exhibit E - Berm and Landscape Plan. (Exhibit A rescinded;
see Condition No. 5)
2. The trees to be planted as shown on Exhibit E shall have a minimum diameter
of two and one-half inches one foot above the ground.
3. The storm sewer in the parking lot shall remain the property of the Park
Assembly of God Church as far as the easterly property line. A drop inlet with
a clean out shall be provided on the public property and shall be placed in City
ownership.
4. Construction of the parking lot and related improvements shall be completed
by June 15, 1981.
5. That Exhibit A, Site Plan, Phase I, in Condition 1 be replaced by Exhibit AA,
Site Plan as it relates to buildings, elevations and the south parking lot, but
that the parking lot located north of the building be subject to setbacks as set
forth in the Zoning Ordinance
6. That no grading or fill be allowed below the 100 year flood elevation of 886.0
feet (NGVD)
7. That all improvements be completed prior to issuance of final Certificate of
Occupancy.

Property Legal Description
Par 1: Lot 5 except the South 299 feet thereof, Beebe's Outlots, according to the plat
thereof on file or of record in the office of the Registrar of Titles in and for said County.
Subject to a right-of-way across the front or West portion of said Lot 5; now being
used for roadway purposes;
Par 2: The West 240 feet of the North 25 feet of the South 299 feet of Lot 5;
Lot 6 except that part thereof embraced within the plats of Texas Terrace and Texas
Terrace second Addition, and except that part of said Lot 6 lying West of the West line of
Texas Avenue; except that part of said Lots 5 & 6 lying West of a line drawn parallel with the
West line of Lot 6 and its Southerly extension from the Southeast
corner of said Texas Terrace Second Addition.
All in Beebe's Outlots, according to the plat thereof on file or of record in the office of the
Registrar of Titles in and for said County.
Par 3: Outlot 2, Texas Terrace, according to the plat thereof on file or of record in the office
of the Registrar of Titles in and for said County.
Par 4: Outlot 2, Lamplighter, according to the plat thereof on file or of record in the office
of the Registrar of Titles in and for said County.
Par 6: That part of the Northwest Quarter of the Southwest Quarter in Section 5,
Township 117, Range 21, lying South of the most Southerly line of the plat of Turf and
Paddock and its Easterly extension and East of the plat of Texas Terrace Third Addition.
Except the South 25.00 feet of the West 570.00 feet of the East 600.00 feet thereof.
