A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-123.100 OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO PERMIT
CONSTRUCTION OF A SHIPPING/RECEIVING DOCK ENCLOSURE
WITHIN THE FLOODPLAIN FOR PROPERTY ZONED F-2, FLOODPLAIN,
AND I-1, INDUSTRIAL DISTRICTS LOCATED AT 7317 WEST LAKE
STREET
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Milastar Corporation (Flame Metals Processing Corporation) has made application to
the City Council for a special permit under Section 14-123.100 of the St. Louis Park
Ordinance Code for the purpose of construction of a shipping/receiving dock enclosure
within the floodplain within the F-2, Floodplain, and I-1, Industrial Districts, located at
7317 West Lake Street for the legal description as follows, to -wit:
See Attached Exhibit A
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 91 -35 -SP) and the effect of the proposed construction of a
shipping/receiving dock enclosure within the floodplain on the health, safety and welfare
of the occupants of the surrounding lands, the effect on values of properties in the
surrounding area, the effect of the use on the Comprehensive Plan, and compliance with
the intent of the Zoning Ordinance.
3. The Council has determined that the construction of a shipping/receiving
dock enclosure within the floodplain will not be detrimental to the health, safety, or
general welfare of the community, nor will it cause hazards, nor will it seriously depreciate
surrounding property values, and the proposed construction of a shipping/receiving dock
enclosure within the floodplain is in harmony with the general purpose and intent of the
Zoning Ordinance and the Comprehensive Plan.
4. The contents of Planning Case File 91 -35 -SP are hereby entered into and
made part of the public hearing record and the record of decision for this case.
Conclusion
The special permit to permit construction of a shipping/receiving dock enclosure
within the floodplain at the location described is granted based on the findings
set forth above and subject to the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - Site
Plan, as modified by the following, such document incorporated by reference herein:
A. 20 cubic yards of compensating flood storage shall be provided at the south
side of the existing building.
B. The location where 19 additional parking spaces could be added and hard
surfaced if required by the City, labeled "proof of parking".
C. The surface material of the fire lane as shown on Exhibit A will be modified to
show crushed rock rather than bituminous.
2. That the lowest floor elevation of the addition be 894.8 feet N.G.V.D. or higher.
3. That the addition meet all of the floodproofing requirements of the State Building
Code.
4. That all improvements be completed prior to issuance of a Certificate of Occupancy.

Par 1: A11 of Lot 17, Block 161.
Par 2: That part of the Northwesterly 100 feet of Lot 16, Block 161, lying Southwesterly of the Southeasterly extension of a
line running parallel with and 90.75 feet Northeasterly of the Southwesterly line of Lot 18, said Block 161.
Par 7: Lot 19. Block 161.
Rearrangement of St. Louie Park, according to the plat thereof on file or of -record in the office of the Register of Deeds in and
for said County.

PARCEL 4: That part of Lot 18, Block 161, "Rearrangement of St. Louis Park", lying north-
easterly of a line run parallel with and distant 10 feet southwesterly, measured
radially from the centerline of spur track I.C.C. 260 of the Chicago, Milwaukee,
St. Paul and Pacific Railroad Company and the former Minneapolis and St. Louis Railway
Company (now the Chicago and North Western Railway Company ), as same track is
now located, and lying southwesterly of a line parallel with and distant 10 feet
south-westerly, measured at right angles, from the southeasterly extension of the
tangent segment of said spur tract.
PARCEL S: All that part of Lot 18, Block 161, in "Rearrangement of St. Louis Park" lying
southwesterly of a line drawn parallel with and distant 10 feet southwesterly of as measured at right angles and radially
from the centerline of Spur Track I.C.C. 260 of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company and the
former Minneapolis S St. Louis Railway Company, now the Chicago and North Western Railway Company, as now located and
established.
