HomeMy WebLinkAbout91-177 - ADMIN Resolution - City Council - 1991/09/16RESOLUTION NO. 91-177 RESOLUTION AUTHORIZING PURCHASE OF LANDS AND TEMPORARY CONSTRUCTION EASEMENTS FOR RIGHT OF WAY FOR THE RECONSTRU TION OF BROOKSIDE BRIDGE PROJECT WHEREAS, The City Council of St. LouisPark has authorized and directed the City Manager to negotiate with the owners of property for the purchase of land and temporary construction easements for right-of-way purposes and construction thereof; WHEREAS, pursuant to such negotiations, Judith A. Braun indicated a willingness to sell, and grant temporary easements, over portions of 4313 Yosemite Avenue for the sum of $1,500, and Alden S. Syverson and Jacquelyn E. Wetterling indicated a willingness to sell, and grant temporary easements over portions of 4352 Brookside Avenue South for the sum of $590.63; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of St. Louis Park that the City of St. Louis Park purchase lands and obtain temporary construction easements within portions of real property located in Hennepin County, Minnesota, as follows: 1. A temporary construction easement containing approximately 298.2 square feet located within Lot 12, Block 3, Brookside and more commonly described as 4313 Yosemite, St. Louis Park, Minnesota; 2. Fee acquisition of real property containing approximately 393 square feet located within Lot 12, Block 3, Brookside and more commonly described as 4313 Yosemite, St. Louis Park, Minnesota; 3. A temporary construction easement containing approximately 2,089.6 square feet located within Lot 1, Block 6, Brookside and more commonly described as 4352 Brookside Avenue South, St. Louis Park, Minnesota; and 4. Fee acquisition of real property containing approximately 312.5 square feet located within Lot 1, Block 6, Brookside and more commonly described as 4352 Brookside Avenue South, St. Louis Park, Minnesota. RESOLVED, FURTHER, that the Mayor and City Manager are hereby authorized to execute the purchase agreements, easement documents, and any and all other instruments required to consummate the transactions contemplated by these Resolutions, all in forms acceptable to the City Attorney for the City of St. Louis Park, and the City Manager is hereby authorized and directed to pay the amounts set forth above, plus costs ancillary to the transactions, including survey, title insurance and attorneys' fees and costs, if any, upon delivery of a commitment for the issuance of a policy of title insurance, which has been marked up at the closing of the transactions, insuring the City of St. Louis Park that it has good and marketable title to the lands and temporary easements to be acquired, subject only to matters approved by the City of St..Louis Park and the City Attorney of the City of St. Louis Park.
