HomeMy WebLinkAbout91-155 - ADMIN Resolution - City Council - 1991/08/19RESOLUTION NO. 91-155 A RESOLUTION RESCINDING RESOLUTION NO. 88-8 ADOPTED ON January 19, 1988 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTIONS 14-156(11) and 14-123.100(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW AN AMENDMENT TO THE LANDSCAPE PLAN AT 8600 HIGHWAY 7 FINDINGS WHEREAS, Minnesota Federal Savings and Loan Association (Norwest Properties, Inc.) has made application to the City Council for a special permit under Sections 14-156(11) and 14-123.100(2) of the St. Louis Park Ordinance Code to allow an amendment to the landscape plan at 8600 Highway 7 within the B-2, General Business, and F-2, Floodplain Districts, having the following legal description: Tract X, except that part thereof lying Easterly of a line erected perpendicular to the Northerly line of said Tract X, from a point on said Northerly line distant 268.76 feet Westerly from the most Northerly corner of said Tact X as measured along said Northerly line, lying Easterly of a line drawn parallel with said last described perpendicular line and distant 130 feet Westerly therefrom, in Registered Land Survey No. 1058, Files of Registrar of Titles, County of Hennepin (Torrens Certificate No. 392313) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission Case Nos. 87 -90 -SP and 91 -30 -SP and the effect of the proposed amendment to the landscape plan on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 88-8 of the St. Louis Park City Council dated January 19, 1988 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 88-8 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Case Files 87 -90 -SP and 91 -30 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 88-8 filed as Document No. 1905079 is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting an amendment to the landscape plan within the B-2, General Business, and F-2, Floodplain Districts at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan with landscaping as modified by Exhibit D referred to in Condition No. 3, Exhibit B - Elevations and Exhibit C - Grading and Drainage Plan as modified to show a catch basin in the northerly portion of the site and continuous curbing along the north side of the new parking area, such documents incorporated by reference herein. 2. All improvements shall be completed by October 31, 1988. 3. Landscaping on the site shall be developed, used and maintained in accordance with Exhibit D - Landscape Plan dated July 12, 1991, such document incorporated by reference herein. Landscaping shall be installed by August 19, 1992.
