XS WHEREAS, pursuant to advertisement for bids for Improvement Project Nos. 90-33, 89-16 and 86-02, bids were received, opened and tabulated by the Director of Public Works on July 31, 1991. Said bids were as follows: Bidder Bid Price J.P. Norex, Inc. $ 802,983.65 C.S. McCrossan, Inc. 836,976.56 Hardrives, Inc. 853,023.70 Valley Paving, Inc. 854,486.93 Alber Construction, Inc. 929,338.55 Engineer's Estimate: $ 670,000.00 WHEREAS, the bid of J.P. Norex, Inc. of Chanhassen, Minnesota submitted a bid after the time for receipt of bids had expired, yet prior to the opening and reading of any bids related thereto; and WHEREAS, it appears that J.P. Norex, Inc. of Chanhassen, Minnesota has submitted the lowest bid. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis Park, Minnesota that: 1. It hereby waives the irregularity of the J.P. Norex, Inc. bid caused by its submittal after the time for receipt of the bids had expired and declares that acceptance of the bid is in the City's best interest and no damages will be inflected on others thereby. 2. The bid of J.P. Norex, Inc. of Chanhassen, Minnesota is the lowest responsible bid. 3. The Mayor and City Manager are hereby authorized and directed to enter into a contract in the amount of $802,983.65 with J.P. Norex, Inc. of Chanhassen, Minnesota in the name of the City of St. Louis Park, for Improvement Project Nos. 90-33, 89-16 and 86-02 according to the plans and specifications approved by the City Council and on file in the office of the Director of Public Works. 2. The City Clerk is hereby authorized and directed to return to all bidders the deposits made with their bids in accordance with the bid documents, except that the deposit of the successful bidder and the next lowest bidder shall be retained until a contract has been executed.
