A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTION 14-123 OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO PERMIT CONSTRUCTION OF A DISCHARGE
OUTFALL LINE FOR PROPERTY ZONED I-1, GENERAL INDUSTRIAL,
AND F-1, FLOODWAY DISTRICTS LOCATED AT 3960 MEADOWBROOK
ROAD
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. State of Minnesota (Ruth Schloff) has made application to the City Council for a special
permit under Section 14-123 of the St. Louis Park Ordinance Code for the purpose of
construction of a discharge outfall line within the I-1, General Industrial, and F-1,
Floodway Districts located at 3960 Meadowbrook Road for the legal description as follows,
to -wit:
A 10 foot easement for drainage purposes over, under and across that part of
the Southwest 1/4 of the Northwest 1/4 of Section 20, Township 117 North,
Range 21 West, Hennepin County, Minnesota, described more particularly as
follows:
BEGINNING at the most westerly corner of Lot 4, Block 1, Carlson's
Creekside Addition, at a set survey monument marked "Kemper 18407";
thence S 50 degrees 05 minutes E, record bearing along the southwesterly line
of said Lot 4, Block 1, a distance of 10.08 feet; thence S 46 degrees, 48
minutes, 46 seconds W a distance of 44.83 feet; thence S 38 degrees 57
minutes 36 seconds W a distance of 34.11 feet; thence N 51 degrees 02 feet 24
seconds W a distance of 10.00 feet; thence N 38 degrees 57 minutes 36 seconds
E a distance of 34.84 feet; thence N 46 degrees 48 minutes 46 seconds E a
distance of 44.25 feet to the POINT OF BEGINNING. Said easement contains
790 square feet. (Abstract)
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 90 -78 -SP) and the effect of the proposed discharge outfall line on the
health, safety and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area, the
effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning
Ordinance.
3. The Council has determined that the discharge outfall line will not be detrimental to the
health, safety, or general welfare of the community nor will it cause serious traffic
congestion nor hazards, nor will it seriously depreciate surrounding property values, and the
proposed discharge outfall line is in harmony with the general purpose and intent of the
Zoning Ordinance and the Comprehensive Plan.
4. The contents of Planning Case File 90 -78 -SP are hereby entered into and made part of
the public hearing record and the record of decision for this case.
Conclusion
The special permit to permit a discharge outfall line at the location described is granted
based on the fmdings set forth above and subject to the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A
- Site Plan, and Exhibit B - Profile -Discharge Line, such documents
incorporated by reference herein.
2. All improvements shall be completed by December 15, 1991.
