A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTION 14-156(6) OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO PERMIT THE RETAIL SALE OF NEW AND
USED AUTOMOBILES AND TRUCKS FOR PROPERTY ZONED B-2,
GENERAL BUSINESS DISTRICT LOCATED AT 6905 WAYZATA
BOULEVARD
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Sanford Sandelman and National Boulevard Associates (James Lupient) have made
application to the City Council for a special permit under Section 14-156(6) of the St. Louis
Park Ordinance Code for the purpose of the retail sale of new and used automobiles and
trucks within a B-2, General Business District, located at 6905 Wayzata Boulevard for the
legal description as follows, to -wit:
Lot 117 "Richmond" (Abstract)
Lots 118, 119 and 230 except highway, Lots 120 and 121, "Richmond",
according to the plat thereof on file or of record in the office of the Register of
Deeds in and for said County (Torrens Certificate No. 741408)
The North 2 feet of Lot 122 "Richmond" (Abstract)
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 90 -77 -SP) and the effect of the proposed retail sale of new and used
automobiles and trucks on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area, the effect of the use on the Comprehensive Plan, and
compliance with the intent of the Zoning Ordinance.
3. The Council has determined that the retail sale of new and used automobiles and trucks
will not be detrimental to the health, safety, or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed retail sale of new and used automobiles and trucks is in
harmony with the general purpose and intent of the Zoning Ordinance and the
Comprehensive Plan.
4. The contents of Planning Case File 90 -77 -SP are hereby entered into and made part of
the public hearing record and the record of decision for this case.
Conclusion
The special permit to permit retail sale of new and used automobiles and trucks at the
location described is granted based on the findings set forth above and subject to the
following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A
- Site Plan, Exhibit B - Elevation Plan, Exhibit C - Floor Plan and Exhibit D -
Landscape Plan, except that the parking space located within the front yard
setback northwesternmost be eliminated, such documents incorporated by
reference herein.
2. No motor vehicle transport loading or unloading shall be permitted on the
public right of way.
3. That 22 parking spaces shall be designated for employee and customer
parking.
4. No vehicles being offered for sale shall be parked on Idaho Avenue.
5. No test driving of vehicles shall be permitted on residential streets.
6. No public address systems or speakers shall be installed external to the
building.
7. No storage, display or parking of vehicles shall be allowed in any of the setback
or landscaped areas, as shown on Exhibit D.
8. Exterior lighting shall be designed so that no direct, off-site views of the light
source are visible and that reflected glare and spill light shall not exceed 0.5
footcandles at the abutting residential property line.
9. The landscape plan be modified to include 6 canopy trees along the boulevards
of the frontage road and Idaho Avenue. The minimum size of these trees shall
be 2 1/2 caliper inches.
10. The certificate of occupancy shall not be issued until a franchise selling
agreement for new motor vehicles is presented to the City which authorizes
the sale of new motor vehicles on the subject property.
11. A cash deposit amounting to 110 percent of the estimated cost of all
unfinished site work shall be submitted to the City prior to the issuance of a
certificate of occupancy.
12. All improvements be completed by December 31, 1991.
