RESOLUTION OF THE CITY OF ST. LOUIS PARK RELATING TO THE
BASSETT CREEK FLOOD CONTROL PROJECT AND AUTHORIZING THE
BASSETT CREEK WATER MANAGEMENT COMMISSION TO CONTRACT
WITH THE CITIES OF GOLDEN VALLEY, MINNEAPOLIS AND
PLYMOUTH TO CONSTRUCT CERTAIN RELOCATION PROJECTS
WHEREAS, the City of St. Louis Park is a member of a joint powers water
management organization known as the Bassett Creek Water Management Commission, and
WHEREAS, the Bassett Creek Water Management Commission and the City of
Minneapolis as the local sponsors are in the process of completing a joint project with the
United States Army Corps of Engineers which will assist in providing flood control
protection for the entire watershed and the cost is approximately 38 million dollars, and
WHEREAS, the Bassett Creek Water Management Organization adopted Resolution
No. 2-1991 on October 17, 1991, which relates to three parts of the overall project which are
classified as relocation and the total responsibility for the cost of constructing these
relocations falls upon the nine member Cities, and
WHEREAS, this Council has reviewed Resolution No. 2-1991, a copy of which is
attached and made a part of this resolution, and agrees that the Bassett Creek WMO should
contract with the Cities of Golden Valley, Minneapolis and Plymouth to construct these
projects as local projects rather than to have them constructed by the United Stats Army
Corps of Engineers,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of St. Louis
Park, as follows:
1. It is hereby determined that the local construction and relocation projects at
Westbrook Road in the City of Golden Valley, Medicine Lake Outlet in the City of Plymouth
and Penn Avenue in the City of Minneapolis would be best handled at a local level since they
are a local responsibility and are to be paid for entirely by local funds.
2. The City is advised that the Cities of Golden Valley, Plymouth and
Minneapolis are willing to contract pursuant to law for the necessary labor and materials to
make said relocations and to manage said construction projects. Agreements between the
Bassett Creek Water Management Commission and the Cities of Golden Valley, Plymouth
and Minneapolis are approved, and the funds for these three projects shall be provided by
the Bassett Creek Water Management Commission on the same proportionate basis as other
projects being constructed by the Corps or under the Local Cooperative Agreement between
the City of Minneapolis and the United States government.
3. The City agrees that the method chosen by the Bassett Creek Water
Management Commission for proceeding is in the best interest of all members of the Bassett
Creek Water Management Organization because it is estimated that local construction can
save approximately $200,000. The purpose of this Resolution is to assure the Bassett Creek
Water Management Commission that it has the authority to disperse the funds collected for
the over-all project to members Cities who will contract for said work rather than to have the
funds spent by the Corps of Engineers.
4. A certified copy of this Resolution shall be sent to the Bassett Creek Water
Management Organization authorizing them to proceed as outlined in the Bassett Creek
Water Management Organization Resolution No. 2-1991.
Adopted by the City Council of the City of St. Louis Park the 16th day of December,
1991.
