HomeMy WebLinkAbout91- 209 - ADMIN Resolution - City Council - 1991/12/04r RESOLUTION NO. 91- 2 0 9 A RESOLUTION RESCINDING RESOLUTION NO. 91-1 ADOPTED ON JANUARY 7, 1991 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-123.100 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A ONE YEAR EXTENSION TO PERMIT CONSTRUCTION OF A SINGLE FAMILY HOUSE IN THE FLOODPLAIN FOR PROPERTY ZONED R-1, SINGLE FAMILY RESIDENCE, AND F-2, FLOODPLAIN DISTRICTS LOCATED AT 1400 PENNSYLVANIA AVENUE FINDINGS WHEREAS, Karen Sakol and Bruce Tjosvold have made application to the City Council for a special permit under Section 14-123.100 of the St. Louis Park Ordinance Code to allow a one year time extension to permit construction of a single family house in the floodplain at 1400 Pennsylvania Avenue within the R-1, Single Family Residence, and F-2, Floodplain Districts having the following legal description: Par 5: Beginning on the East line of the Northwest Quarter of the Southwest Quarter in Section 5, Township 117, Range 21, 850 feet South of the Northeast corner thereof, thence West along the South line of 14th Street as shown in the plat of Turf and Paddock, 209.8 feet to the Northeast corner of Lot 21, Turf and Paddock, Hennepin County, Minnesota, thence South along the East line of said Lot 21, to the Southeast corner thereof distant 210 feet, thence East parallel with the North line of said Northwest Quarter of the Southwest Quarter to the East line thereof, thence North along the East line thereof to the South line of 14th Street, being the point of beginning. (Torrens) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission Case No. 90 -81 -SP and 91 -42 -SP and the effect of the proposed time extension to permit construction of a single family house in the floodplain on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 91-1 of the St. Louis Park City Council dated January 7, 1991 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 91-1 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Commission Case Files 90 -81 -SP and 91 -42 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 91-1 filed as Document No. 2148670 is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting a one year time extension to permit construction of a single family house in the floodplain within the R-1, Single Family Residence, and F-2, Floodplain Districts at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A, Site Plan, such documents incorporated by reference herein. 2. That a registered engineer or architect certify that the finished fill and building elevations are accomplished in accordance with Section 14-123.100(2) and Exhibit A prior to issuance of a Certificate of Occupancy. 3. That no fill be placed below the 100 -year flood plain elevation of 886.0 feet NGVD unless an equal or greater amount of compensating flood storage capacity is provided. 4. The lowest floor elevation of any structure constructed on the lot shall be at or above the flood protection elevation of 887.0 feet NGVD (176.3 feet City Datum). 5. That a one year time extension shall be granted and all improvements shall be completed by December 31, 1992.
