HomeMy WebLinkAbout90-9 - ADMIN Resolution - City Council - 1990/01/16EssawrICN NO. 90-9: RESOLUTION AUTHORIZING PURCHASE OF TEMPORARY CONSTRUCTION EASEMENTS AND P p'. is SLOPE EASEMENT FOR THE STATE HIGHWAY NO.7 AND LOUISIANA AVENUE PROJECT WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with the owners of property for the purchase of temporary construction easements and a permanent slope easement, and WHEREAS, pursuant to such negotiations, Mill City Plywood has indicated their desire to sell said easements for an amount of $7,083 for temporary construction easements and permanent slope easement for highway purposes, and NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park that the City of St. Louis Park purchase the following -described easements in Hennepin County, Minneseota, to -wit: A permanent slope easement over: That part of Lots 5, 6, 7 and 8, Block 324, Rearrangement of St. Louis Park, and the Northwesterly 1/2 of First Street Northwest lying Westerly of Line "A". Line "A" is described as a line drawn between the most Northerly corner of said Lot 6 and a point in the Southerly line of the Northwesterly 1/2 of vacated First Street Northwest 200 feet Southwesterly of the point of intersection of Southerly line with the extension across said street of the curved Southerly line of Lot 18 in said Block. Said curved Southerly line of Lot 18 is the Easterly line of that portion of said vacated street. Which lies Westerly of Line "A" and Easterly of a line drawn from a point in said Lot 5 distant 10 feet as measured along the Northeasterly line from the most Northerly corner of said Lot 6 to a point in said Line "A" distant 120 feet Southerly of the most Northerly corner of said Lot 6 and there terminating. This_area contains approximately 600 square feet. Torrens Certificate #538752 Together with: Temporary construction easements to expire December 31, 1993 over an area indicated in green on the attached exhibit. Mayor and City Manager are hereby authorized to execute any and all instruments necessary to complete the purchase of said easements, and the City Manager is hereby authorized and directed to pay the indicated suns frau the Special Assessment Construction Fund (25-4470-385-70) to Mill City Plywood, upon delivery by Mill City Plywood of the easement documents accompanied by an Abstract of Title or Owner's Certificate of Title showing good and marketable title of record to said easements,together with an opinion by the City Attorney of the City of St. Louis Park approving the transfer documents. Adopted by the City Council January 16, 1990.
