RESOLUTION NO. 90-8
RESOLUTION AUTHORIZING THE PURCHASE OF PROPERTY AND
AMENDING THE PURCHASE AGREEMENT FOR PROPERTY LOCATED
AT 6333 W. 37TH STREET.
WHEREAS, on August 15, 1988 the City Council of St. Louis Park authorized
and directed the Acting City Manager to negotiate with the Estate of Andrew L.
Turner and Edna Turner for the purchase of the fee title to certain the land for
public uses; and
WHEREAS, Wayne Bye, the Personal Representative of the Estate, executed a
Purchase Agreement dated September 6, 1988 for the sale of said land to the City
by General Warranty Deed for the sum of $16,700; and
WHEREAS, the City of St. Louis Park has completed the purchase of 'a portion
of the above -referenced land and wishes to amend said Purchase Agreement to (i)
provide for the purchase of fee title to the remaining portion of the land,
which is hereinafter described, for the remaining amount of the original
purchase price, (ii) to require seller to escrow $3,000 of the seller's proceeds
to ensure the completion of the action to clear title, (iii) to obligate the
City to exercise its power of eminent domain with repect to said land if
necessary; and
WHEREAS, the City of St. Louis Park wishes to exercise its power of eminent
domain to create marketable title to the property, to the extent permitted by
law if such action becomes necessary; and
NOW THEREFORE BE IT RESOLVED by the City Council of St. Louis Park that the
City of St. Louis Park purchase the following described property located in
Hennepin County, Minnesota, to wit:
The East 43 feet of that portion of Lots 27-31, inclusive,
Block 50, "Rearrangement of St. Louis Park," lying West of a line
drawn parallel with and 91 feet East from the West line of said
Block 50 and its northerly extension (commonly known as 6333 W.
37th Street)
and the Mayor and City Manager are hereby authorized to execute any and all
instruments necessary to complete the purchase of said property and the City
Manager is hereby authorized and directed to accept delivery of the deed and to
pay the purchase price from the Special Assessment Construction Fund. This
purchase is subject to the City Attorney's approval of the executed deed and
title evidence.
