LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT DIAGNOSTIC IMAGING CENTER FOR PROPERTY ZONED PUD, PLANNED UNIT DEVELOPMENT DISTRICT LOCATED AT 4951 EXCELSIOR BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findines 1. Park Nicollet Medical Foundation (Park Nicollet Medical Center) has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the purpose of allowing a Diagnostic Imaging Center within a PUD, located at 4951 Excelsior Boulevard for the legal description as follows, to -wit: That part of Section 7, Township 28 North, Range 24 West of the 4th Principal Meridian, described as follows: Beginning at a point in the centerline of Excelsior Boulevard, distant 1056.00 feet northeasterly from its intersection with the centerline of Wooddale Avenue; thence South 25 degrees 41 minutes 21 seconds East, along a line which passes through the northeast corner of Lot 22, Block 1, Brookview Addition, Hennepin County Minnesota, 529.34 feet to the south line of the Northeast 1/4 of the Northwest 1/4 of said Section 7; thence South 89 degrees 28 minutes 16 seconds East, along said south line 109.30 feet to the southwest corner of Douglas Park, now vacated (this being the west line of Quentin Avenue as opened); thence North 00 degrees 05 minutes 11 seconds west, along the west line of said Quentin Avenue, 622.61 feet to said centerline of Excelsior Boulevard; thence South 66 degrees 49 minutes 47 seconds West along said centerline 367.46 feet to the point of beginning. Subject to the rights of the public in Excelsior Boulevard and Quentin Avenue. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 90 -32 -SP) and the effect of the proposed Diagnostic Imaging Center on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the Diagnostic Imaging Center will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed Diagnostic Imaging Center is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 4. The contents of Planning Case File 90 -32 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. Conclusion The special permit to permit Diagnostic Imaging Center at the location described is granted based on the findings set forth above and subject to the following conditions: 1. Occupancy of the structure as a Diagnostic Imaging Center is conditioned upon maintenance of the property in the same manner as indicated on Exhibit A, preliminary plat for Hoyt Second Addition as it relates to the physical appearance of the property. Any modification to this shall require an amendment to the special permit. Minor modification to the exterior of the building such as addition or deletion of a door or window may be permitted without special permit amendment. 2. Any dead landscaping materials on the site shall be removed and replaced with material of a like kind and quality and all weeds and other materials shall be removed. Landscaping shall continue to be maintained. 3. All trash storage shall be located entirely within the principal building. 4. No occupancy of the westerly building on the site shall be permitted under this special permit. An amendment to this special permit shall be necessary in order to permit occupancy of the westerly building. 5. No lighting shall be permitted on the site which directs light rays directly across property lines. 6. A stop sign for vehicles exiting on to Quentin through the southerly curb cut shall be installed. 7. All improvements shall be completed before an occupancy permit may be issued by the City.
