RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF
KNOLLWOOD GREEN
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. JMS Equities Inc., owners and subdividers of the land proposed to be platted as
Knollwood Green have submitted an application for approval of final plat of said subdivision
in the manner required for platting of land under the St. Louis Park Ordinance Code, and all
proceedings have been duly had thereunder.
2. The proposed final plat has been found to be in all respects consistent with the
City Plan and the regulations and requirements of the laws of the State of Minnesota and
the ordinances of the City of St. Louis Park.
3. The proposed plat is situated upon the following described lands in Hennepin
County, Minnesota, to -wit:
That part of the Northwest Quarter of the Southwest Quarter, Section 18,
Township 117, Range 21, Hennepin County, Minnesota, described as follows:
Commencing at the northwest corner of the Southwest Quarter of said
Section 18, thence on an assumed bearing of South 89 degrees 59 minutes
26 seconds East along the north line of said southwest Quarter a distance
of 585.18 feet to the point of beginning of the land to be described; thence
South 37 degrees 26 minutes 02 seconds East, 85.32 feet; thence South 30
degrees 58 minutes 46 seconds East, 99.05 feet; thence southeasterly
189.44 feet along a tangential curve, concave to the northeast, having a
radius of 1010.41 feet and a central angle of 10 degrees 44 minutes 33
seconds; thence South 41 degrees 43 minutes 19 seconds east, tangent to said
curve, 162.51 feet; thence South 36 degrees 46 minutes 18 seconds East, 289.02
feet to the southerly extension of the west line of Flag Avenue, as dedicated in
Minnehaha Gables 2nd Addition; thence northerly along the southerly extension
of said west line of the north line of said Southwest Quarter; thence North 89
degrees 59 minutes 26 seconds west along said north line to the point of beginning.
Reserving to the County of Hennepin an easement, 20.00 feet in width,
for drainage purposes across that part of the above described tract of
land lying 10.00 feet on each side of the following described center line:
Beginning at a point on the southwesterly line of the above described
tract of land distant 275.37 feet southeasterly, as measured along said
southwesterly line, from the northwesterly corner of said tract of land; thence
North 72 degrees 30 minutes East, 40.00 feet and said center line there
terminating.
The side lines of said easement extend from the southwesterly line of the
above described tract of land to a line which is perpendicular to the
above described center line at its point of termination.
Also reserving to the County of Hennepin, a permanent easement for wall
maintenance purposes over the southwesterly 10 feet of said tract.
Also reserving to the County of Hennepin all mineral rights in said land
pursuant to M.S.A. 373.01.
Also reserving to the County of Hennepin the right of access, being the
right of ingress to and egress from the tract of land herein being
conveyed to said County State Aid Highway No. 18.
Conclusion
1. The proposed final plat of Knollwood Green is hereby approved and accepted by
the City as being in accord and conformity with all ordinances, City plans and regulations of
the City of St. Louis Park and the laws of the State of Minnesota, provided, however, that
this approval is made subject to the opinion of the City Attorney and Certification by the
City Clerk as provided for in Sections 14-303(3)(d) and (e) of the St. Louis Park Ordinance
Code. The documents required herein shall be acceptable in form and substance to the City
Attorney before the opinion referred to herein is issued. In the event the City Attorney and
developer cannot agree, then the developer agrees that the plat is not approved and shall be
returned to the Council for further action. Documents required herein shall include but not
be limited to an owner's policy for title insurance insuring the City's interests in the plat or
an attorney's title opinion addressed to the City, a contract requiring the subdivider tc,
construct the public improvements and a performance bond or undertaking by a corporate
surety or bank to secure the subdivider's obligation.
. 2. The City Clerk is hereby directed to supply two certified copies of this Resolution
to the above-named owner and subdivider, who is the applicant herein.
3. The Mayor and City Manager are hereby authorized to execute all contracts
required herein, and the City Clerk is hereby directed to execute the certificate of approval
on behalf of the City Council upon the said plat when all of the conditions set forth in
Paragraph No. 1 above and Section 14-303(3)(e) of the St. Louis Park Ordinance Code have
been fulfilled.
4. Such execution of the certificate upon said plat by the City Clerk, as required
under Section 14-303(3)(e), shall be conclusive showing of proper compliance therewith by
the subdivider and City officials charged with duties above described and shall entitle such
plat to be placed on record forthwith without further formality.
