A RESOLUTION RESCINDING RESOLUTION NO. 89-19 ADOPTED ON
FEBRUARY 21, 1989, AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-124.101(2) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO ALLOW OUTDOOR
DINING AT 300, 400, 600 SOUTH HIGHWAY 169 AND 435 FORD ROAD
FINDINGS
WHEREAS, Equitable Life Assurance Society of the United States (Equitable Real Estate
Investment Management) has made application to the City Council for a special permit
under Section 14-124.101(2) of the St. Louis Park Ordinance Code to allow outdoor dining
at 400, 600 South Highway 169 and 435 Ford Road in a PUD, Planned Unit Development
District having the following legal description:
Lots 2 and 3 and that part of Lot 1 lying easterly of a line running from a point
in North line of Lot 1 distant 64 51/100 feet West from Northeast corner
thereof to a point in South line of Lot 1 distant 68 97/100 feet westerly from
Southeast corner thereof, Block 7, Shelard Park (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission Case No. 89 -2 -SP, and 86 -43 -SP and City Council Case No. 90 -35 -SP
and the effect of the proposed outdoor dining on the health, safety, and welfare of the
occupants of the surrounding lands, existing and anticipated traffic conditions, the effect
on values of properties in the surrounding area and the effect of the use on the
Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 89-19 of the St. Louis Park City Council dated February 21, 1989 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions of
the permit granted by Resolution No. 89-19 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Commission Case File 89 -2 -SP and 86 -43 -SP and
City Council Case File 90 -35 -SP are hereby entered into and made part of the public
hearing record and the record of decision for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 89-19 filed as Document No.
5510166 is hereby rescinded and replaced by this resolution which continues and amends a
special permit to the subject property for the purposes of permitting outdoor dining within
the PUD, Planned Unit Development District at the location described above based on the
following conditions:
1. That the site be developed, used and maintained in accordance with Exhibit A - Site
Plan; Exhibit B - Grading Plan; Exhibit C - Site Utility Plans; Exhibit D - Site
Lighting, Exhibit E - Landscape Plan; Exhibit F - Floor Level Parking Plan; Exhibit G
- Middle Level Parking Plan; Exhibit H - First Floor Plan; Exhibit I - Typical Floor
Plan; and Exhibit J1 and J2 - Elevation Plans (Exhibits are on file in the Community
Development Department at the City of St. Louis Park).
2. Due to the need for demolition of existing structures and the magnitude including
the details contained on the landscape plans, lighting plans and interior parking
plans, some slight modifications or adjustments to accommodate the elements
contained on the plans can be allowed without amending the special permit.

3. That all lighting except globe lighting be directed perpendicular to the ground.
4. That all outdoor parking lots be delineated by concrete curb and gutter measuring at
least six inches above and below the grade.
5. The approval from the Minnesota Department of Transportation to use the area
adjacent to the frontage road for landscape/setback purposes be obtained and filed
with the special permit prior to construction of the proposed new office.
6. That the uses permitted and the square footages allowed shall be as stated in the
Final General PUD Plan.
7. Although the applicant and developer are not directly responsible for modification of
the intersection of Ford Road and Shelard Parkway, including noise attenuation as
may be appropriate, the applicant and developer hereby agree to cooperate with the
City in resolution of the design and recognize it is reasonable to seek and obtain
agreement on the intersection plan, and the City, applicant and developer agree to
cooperate on the implementation of the plan thereafter. The applicant and developer
also agree to pay the cost of the noise attenuation (barrier).
8. That all buildings, landscaping, parking lots, lighting and other elements contained
on the exhibits be completed by May 15, 1992.
9. This special permit supersedes any special permits previously issued for the subject
property.
10. The Shelard Park Special Permit shall be amended by deleting the requirement that
all signage in the Shelard Park area be consistent with the shelard Park Sign Policy.
All signage in the area shall be subject to the provisions of the sign portion of the
Zoning Ordinance.
11. The improvements noted as 1989 improvements are hereby approved subject to
compliance with applicant's exhibits: Exhibit A - Site Plan; Exhibit B - Front
Elevation, 300 Interchange North; Exhibit C - Curtain Wall Elevation; Exhibit D -
Front Elevation; Exhibit E - Front Elevation, 400 Interchange South; Exhibit F -
Front Elevation, 600 Interchange Tower; Exhibit G - Front Elevation, 435
Interchange West; Exhibit H - Ramp Connection; and Exhibit I - Landscape Plan.
12. The improvements designated as 1990 Improvements are approved in concept as
shown on applicant's exhibits entitled master plan South Building and Tower and
Master Plan North Building.
13. All improvements labeled as 1989 Improvements shall be completed by December 31,
1989.
14. That condition numbers 11, 12, and 13 be deleted.
15. That outdoor dining be allowed in the area indicated on Exhibit K - Outdoor Dining
Site Plan and Exhibit L - Outdoor Dining Plan.
