HomeMy WebLinkAbout90-178 - ADMIN Resolution - City Council - 1990/12/03RESOLUTION NO. 90-179 A RESOLUTION RESCINDING RESOLUTION NO. 89-188 ADOPTED ON DECEMBER 4, 1989 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTIONS 14-123.100(2) AND 14-107(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW CONSTRUCTION OF A GROUNDWATER TREATMENT CENTER AND CONSTRUCTION OF AN INDUSTRIAL BUILDING WITHIN 200 FEET OF THE F-1 FLOODWAY DISTRICT AT 3965 MEADOWBROOK ROAD. FINDINGS WHEREAS, Control Data Corporation has made application to the City Council for a special permit under Sections 14-123.100(2) and 14-107(2) of the St. Louis Park Ordinance Code to allow construction of a groundwater treatment center at 3965 Meadowbrook Road within a I-1, Industrial, and F-2 Floodplain Districts having the following legal description: The north 530 feet of the west 468.6 feet of that part of the southeast quarter of the northwest quarter lying southerly of a line drawn easterly from and right angles to the west line of said southeast quarter of the northwest quarter form a point thereof distant 818.8 feet north of the southwest corner thereof Section 20, Township 117 Range 21 WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission Case No. 89 -97 -SP and the effect of the proposed groundwater treatment center on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 89-188 of the St. Louis Park City Council dated December 4, 1989 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 89-188 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Commission Case Files 89 -97 -SP and 90 -80 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 89-188 filed as Document No. 2072591 is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting the groundwater treatment center within the I-1, Industrial, and F- 2, Floodplain Districts at the location described above based on the following conditions: 1. That the site shall be developed, used and maintained in accordance with Exhibit A - Site Plan, dated March 17, 1981, and Exhibit B - Floor Plan, except as such exhibits may be necessarily modified by the actions of the Minnehaha Creek watershed District. 2. The Watershed District permit shall be come Exhibit C of this special permit. 3. No addition or part thereof shall be constructed so that the lowest floor elevation is below the flood protection elevation of 185.8 feet City datum (896.1 feet, MSL). 4. The parking lot shall be surfaced according to Ordinance requirements. 5. All construction and improvements shall be completed by October 30, 1982. 6. A security fence and small addition at the northeast corner of the building shall be allowed subject to the following conditions: a. The property shall be developed, use and maintained in accordance with Exhibit D - Site Plan. b. No outside storage shall be permitted, either within the fenced enclosure or elsewhere on the site. c. The small building addition must not be metal to conform to the building code. Masonry material to match the existing building must be utilized. d. All improvements shall be completed by May 15, 1984. 7. A one-story masonry enclosure and an outside tank storage area shall be permitted subject to the following conditions: a. The property shall be developed, used and maintained in accordance with Exhibit E - Site Plan. b. The addition shall be painted to match the existing structure. c. All improvements shall be completed by May 5, 1986. 8. • That the site be developed and maintained in accordance with Exhibit A, Site Plan; Exhibit B, Forcemain Alignment; and Exhibit C, Building Plans and Elevations. (Exhibit C modified by Exhibit Cl; see Condition No. 11) (Exhibit A replaced by Exhibit Al; see Condition No. 12) 9. That copies of all governmental agency permits be submitted to the City of St. Louis Park. 10. That all improvements contained in condition 8 and 9 be completed by July 31, 1990. 11. That Exhibit C in Condition No. 8 be modified by Exhibit C1 - Building Elevation. 12. That Exhibit A in Condition No. 8 be replaced by Exhibit Al - Site Plan.
