HomeMy WebLinkAbout90-171 - ADMIN Resolution - City Council - 1990/11/19I) RESOLUTION NO. 90-171 RESOLUTION AUTHORIZING PURCHASE OF TEMPORARY CONSTRUCTION EASEMENTS AND PERMANENT SLOPE EASEMENT FOR THE STATE HIGHWAY NO. 7 AND LOUISIANA AVENUE PROJECT WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with the owners of the property for the purchase of temporary construction easement and a permanent berm slope and utility easement, and WHEREAS, pursuant to such negotiations, U -Save Park Self Storage Limited Partnership has indicated their desire to sell said easements for an amount of $5,000 for temporary construction easement and permanent berm slope easement for highway purposes, and NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park that the City of St. Louis Park purchase the following -described easements in Hennepin County, Minnesota, to -wit: A permanent easement for berm slope and utility purposes over the Southerly 65 feet of Lot 2, Block 1, Irwin Mandel Neil Boderman Addition, which lies Easterly of the Westerly wall of the Easterly building and its Southerly extension, except the area of said Easterly building and the drainage and utility easement dedicated on the plat. Together with: Temporary construction easements to expire December 31, 1993 over: That part of Lot 2, Block 1, "Irwin Mandel Neil Boderman Addition", indicated in green on the attached map. The City agrees not to permit dirt or other material to be of such height as to obstruct the view of the sign on the property. Any sod, trees and landscaping removed in the construction will be replaced with a comparable product in a workmanlike manner. The Mayor and City Manager are hereby authorized to execute any and all instruments necessary to complete the purchase of said easements, and the City Manager is hereby authorized and directed to pay the indicated sums from the Special Assessment Construction Fund (25-4470-385-70) to U -Save Park Self Storage Limited Partnership upon delivery by U -Save Park Self Storage Limited Partnership of the easement documents accompanied by an Abstract of Title or Owner's Certificate of Title showing good and marketable title of record to said easements, together with an opinion by the City Attorney of the City of St. Louis Park, approving the transfer documents.
