LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A 125 UNIT APARTMENT BUILDING AND CANOPY EXTENSION FOR PROPERTY ZONED R -B, RESIDENTIAL BUSINESS DISTRICT LOCATED AT 400-420 FORD ROAD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Northern Gopher Enterprises, Inc. (Kleinman Realty Co.) has made application to the City Council for a special permit under Section 14-146 of the St. Louis Park Ordinance Code for the purpose of permitting a 125 unit apartment building and canopy extension within a R -B, Residential Business District located at 400-420 Ford Road for the legal description as follows, to -wit: That part of Lots 1 and 2, Block 5, Shelard Park, lying easterly of a line drawn from a point on the northerly line of said Lot 1, a distance 32.5 feet easterly of the most westerly corner thereof to a point on the southerly line of said Lot 2, a distance 32.5 feet westerly of the most easterly corner thereof 2. The City Council has considered the staff recommendation (Case No. 90 -73 -SP) and the effect of the proposed 125 unit apartment building and canopy extension on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance 3. The Council has determined that the 125 unit apartment building and canopy extension will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed canopy expansion to a multiple family dwelling is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 4. The contents of Planning Case File 90 -73 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. Conclusion The special permit to permit a 125 unit apartment building and canopy extension at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be -developed, used and maintained in accordance with Exhibit S, Site Plan; Exhibit T, Landscape Plan; Exhibit U, West -North-East Elevation, Wing A; Exhibit V, South -North-West Elevation, Wing B; and Exhibit W, Grading Plan which Exhibits are incorporated by reference herein; except as Exhibit S is modified by Condition No. 2 and subject to the following conditions: a. Earth berms on the side yards area adjacent to Ford Road shall be maintained. b. The area designated as an outdoor tennis court on the site plan shall be retained on the site. c. All improvements, including landscaping, striping, surfacing, concrete curbs, buildings, on-site recreational facilities and all other items on the exhibits shall be completed by June 10, 1972. 2. The site shall be developed, used and maintained in accordance with Exhibit S, Site Plan under Condition 1 except as modified by Exhibit SS - Partial Site Plan to include a canopy at the east entrance of Wing C, Exhibit X - Wing C Front Entrance Elevation and Exhibit Y - Wing C Front Entrance, Side Elevation; which Exhibits are incorporated by reference herein.
