LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO AMEND THE ORIGINAL LANDSCAPE PLAN FOR PROPERTY LOCATED IN THE B-2, GENERAL BUSINESS DISTRICT, AND F-2 FLOODPLAIN DISTRICT AT 8650 HIGHWAY 7 BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota 1. On June 13, 1989, Page Three Incorporated filed an application seeking an amendment to an existing special permit to amend the original landscape plan for property located in the B-2, General Business District, and F-2 Floodplain District at 8650 Highway 7 for the following legal description, to wit: That part of Tract X, Registered Land Survey No. 1058, Files of Registrar of Titles, County of Hennepin, lying Westerly of a line erected perpendicular to the Northerly line of said Tract X from a point thereon distant 268.76 feet Westerly from the most Northerly corner of said Tract X, as measured along said Northerly line, except the Easterly 130 feet thereof, and except that part thereof which lies Westerly of the following described line: Commencing at the Northwest corner of said Tract X; thence on an assumed bearing of North 79 degrees 08 minutes 30 seconds East along the Northerly line of said Tract X, a distance of 25.00 feet to the point of beginning of the line to be described; thence South 25 degrees 57 minutes 15 seconds West to the Westerly line of said Tract X and there terminating. (Torrens Certificate No. 682715) 2. On June 19, 1989 the City Council discussed the application, and authorized preparation of a resolution of denial on a vote of 7-0. 3. Based on the discussion of the application, files and records, the City Council makes the following findings. a. The retaining wall which is proposed occupies a significant portion of the landscape setback area. b. The retaining wall is a structural feature and not a landscape feature. c. The proposed landscape plan does not provide the agreed upon screening of the overhead doors along Highway 7 as does the landscape plan which was approved by Resolution 88-130. 4. The contents of Planning Case File 89 -38 -SP are hereby entered into and made part of the record of decision for this case. CONCLUSION The applicant's request for an amendment to an existing special permit to amend the original landscape plan , at 8650 Highway 7 is hereby denied based on the findings set forth above.
