RESOLUTION NO. 89-84
A RESOLUTION OF FINDINGS REGARDING THE APPLICATION OF
ROBERT V. JOHNSON FOR AN AMENDMENT TO SECTION 14-161 OF
THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO
PERMIT OPEN STORAGE AS A USE ALLOWED BY SPECIAL PERMIT IN
THE B-3 BUSINESS DISTRICT.
BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota:
1. On April 12, 1989, Robert V. Johnson filed an application seeking an amendment to
the Zoning Ordinance to permit open storage in the B-3 District by Special Permit.
2. On May 3, 1989, The Planning Commission reviewed the request and recommended
denial of the request on a vote of 7-0.
3. On June 5, 1989, the City Council held a public hearing, received testimony from the
public, discussed the application, continued the public hearing to June 19, 1989, and
authorized preparation of a resolution of denial on a vote of 4-0.
4. Based on the testimony, evidence presented, and files and records, the City Council
makes the following findings:
a. The proposed ordinance amendment is inconsistent with several
Comprehensive Plan policies including policy 4 on page 5-13 of the
Comprehensive Plan promoting elimination of incompatible land uses, policy 2
on page 7-5 of the Comprehensive Plan which favors light industrial uses and
policy number 5 on page 7-5 which stresses the eventual elimination of non-
conforming industrial uses with nuisance characteristics.
b. The proximity of residential uses immediately adjacent to the area zoned B-3
Business District was one of the primary reasons for the more stringent
controls in the B-3 District as compared to other industrial zoning districts
including the I-2, Industrial Park District.
c. Over half of the properties in the B-3 District abut properties which are
developed for residential purposes.
d. The use of land for open storage purposes abutting residential properties is
incompatible with the goals and policies of the City as expressed in the
Comprehensive Plan.
e. There is no evidence to suggest that the current prohibition of open storage in
the B-3 Business District is in error or that conditions in the City have
changed materially so as to warrant a change in the B-3 Business District
regulations to permit open storage.
6. The contents of Planning Case Number 89-22-ZA are hereby entered into and made
part of the public hearing record and the record of decision for this case.
Conclusion
The applicant's request for an amendment to the Zoning Ordinance to permit open storage
as a Special Permit use in the B-3 Business District is hereby denied based on the findings
set forth above.
