RESOLUTION AUTHORIZING EXECUTION AND FILING OF AFFIDAVIT TO SATISFY
MINNESOTA STATUTES SECTION 1156.16, SUBDIVISION 2 AND SECTION 11.2. OF
THE REMEDIAL ACTION PLAN, ATTACHED AS EXHIBIT A TO THE CONSENT DECREE
ISSUED IN UNITED STATES OF AMERICA, ET AL. VS REILLY TAR & CHEMICAL
CORPORATION, HOUSING AND REDEVELOPMENT AUTHORITY OF ST. LOUIS PARK,
OAK PARK VILLAGE ASSOCIATION, RUSTIC OAKS CONDOMINIUM, INC. AND PHILIP'S
INVESTMENT COMPANY, UNITED STATES DISTRICT COURT, DISTRICT OF MINNESOTA
BE IT RESOLVED by the City Council of the City of St. Louis Park,
Minnesota that the Mayor and City Manager are hereby authorized and directed
to execute an Affidavit for the purposes of satisfying the requirements of
Minnesota Statutes Section 1156.16, Subdivision 2, and Section 11.2. of the
Remedial Action Plan, attached as Exhibit A to the Consent Decree issued in
United States of America, et al. vs. Reilly Tar & Chemical Corporation,
Housing and Redevelopment Authority of St. Louis Park, Oak Park Village
Associates. Rustic Oaks Condominium, Inc., and Philip's Investment Company,
United States District Court, District of Minnesota, Civil File No. 4-80-469,
pertaining to the contamination of certain real property owned by the City by
a release of a hazardous substance as defined in Minnesota Statutes Section
1156.02.
BE IT FURTHER RESOLVED that the City Manager is hereby directed to cause
said affidavit to be filed with the Recorder of Deeds of Hennepin County.
