HomeMy WebLinkAbout89-64 - ADMIN Resolution - City Council - 1989/05/15RESOLUTION NO. 89-64 A RESOLUTION RESCINDING RESOLUTION NO. 88-67 ADOPTED ON JUNE 20, 1988, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTIONS 14-146(1) AND 14-126(4) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW OFF-STREET PARKING FOR PROPERTY ZONED R-3, TWO FAMILY RESIDENCE DISTRICT, LOCATED AT 7855 WAYZATA BOULEVARD FINDINGS WHEREAS, Marvin H. Greenstein has made application to the City Council for a special permit under Section 14-146(1) AND 14-126(4) of the St. Louis Park Ordinance Code to allow off-street parking at 7855 Wayzata Boulevard within a R-3, Two Family Residence District District having the following legal description: That part of the Northwest Quarter of the Southwest Quarter of Section 5, Township 117, Range 21, described as follows: Commencing at a point 930 feet west of the northeast corner of the Northwest Quarter of the Southwest Quarter; thence West 88 feet; thence South along the center line of road 325 feet; thence East 85.6 feet; thence Northerly to beginning, subject to roads. WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case No. 88 -35 -SP) and the effect of the proposed off-street parking on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 88-67 of the St. Louis Park City Council dated June 20, 1988 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the ,conditions of the permit granted by Resolution No. 88-67 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 88-67 (filed as Document No. 5426619 is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting off-street parking within the R-3, Two Family Residence District at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan and Floor Plan for general purposes only (or in the alternative, Scheme B); and Exhibit B - Elevation Plan; subject to the following conditions: a. The net gross feet of office space shall not be more than 1,550 square feet excluding lunch room, restrooms, toilets, etc. b. The parking lot shall be delineated by poured in place concrete curbing measuring six inches above and below grade. c. There shall be no signs on the site zoned R-3, and all other signs shall conform to the sign Ordinance. d. All trees shall be a minimum of 21 inches in diameter, measured one -foot off the ground at the time of planting. e. Improvements on the R-3 portion of the site shall be completed by May 15, 1990, and the improvements on the R -B portion of the site shall be completed by May 15, 1990.
