A RESOLUTION RESCINDING RESOLUTION NO. 2663 ADOPTED ON
SEPTEMBER 14, 1964, AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-124(2) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO ALLOW ERECTION OF
A SIGN AT 2440 SOUTH HIGHWAY 100

WHEREAS, Skylark Company (Win Stephens Companies, Inc.) has made application to
the City Council for a special permit under Section 14-124(2) of the St. Louis Park
Ordinance Code to allow erection of a sign at 2440 South Highway 100 within a DDD,
Diversified Development District having the following legal description:
The part of the South 310 feet of the North 340 feet of the Southwest Quarter of
the Northwest Quarter of Section 31, Township 29, Range 24, lying West of State
Highway No. 100 and lying East of a line drawn at a right angle to the North line of
said quarter quarter and from a point therein distant 375.18 feet East of the Northwest
corner of said quarter quarter, (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case No. 89 -14 -SP and the effect of the proposed erection of a sign
on the health, safety, and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area
and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 2663 of the St. Louis Park City Council dated September 14, 1964 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 2663 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Commission Case Number 89 -14 -SP are hereby
entered into and made part of the public hearing record and the record of decision for
this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 2663 (no Document previously
filed) is hereby rescinded and replaced by this resolution which continues and amends a
special permit to the subject property for the purposes of permitting erection of a sign
within the DDD, Diversified Development District District at the location described above
based on the following conditions:
1. That the lot and structures be used and constructed as shown on the amended Exhibit
â–ºrAtt.
2. That a solid wood fence be constructed along the south property line four to six feet
in height.
3. That no signs and banners be permitted in the front twenty feet.
4. That the hours of operation be from 8:00o'clock a.m. to 9:00o'clock p.m. on weekdays,
from 8:00o'clock a.m. to 6:00o'clock p.m. on Saturdays, and remain closed on Sundays.
6. That no string lights be erected.
6. That no automobiles be placed in the front yard setback for customer parking or for
sales purposes.
7. That all cars to be stored or displayed shall be placed under canopies as shown on
amended Exhibit "A".
8. That the lighting shall be accomplished in such a way that no direct rays of light
shall penetrate beyond the property line.
9. That no cars shall be stored or displayed on the lots for which the permit has been
granted until all sections and conditions of this permit have been met.
10. A free-standing sign is hereby permitted on the site and shall be placed and maintained
according to Exhibit B, Proposed Sign, Win Stephens GMC dated March 2, 1989.
11. All improvements shall be completed by October 30, 1989.
