HomeMy WebLinkAbout89-58 - ADMIN Resolution - City Council - 1989/05/08i 1 RESOLUTION NO. 89-58 A RESOLUTION RESCINDING RESOLUTION NO. 87-64 ADOPTED ON JUNE 15, 1987, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-124.101 AND 14-113(7) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW FILLING, GRADING, AND SEEDING AT THE NORTHEAST CORNER OF EXCELSIOR BOULEVARD AND HIGHWAY 100 FIN DINGS WHEREAS, THE ECONOMIC DEVELOPMENT AUTHORITY OF ST. LOUIS PARK has made application to the City Council for a special permit under Section 14-124.101 AND 14-113(7) of the St. Louis Park Ordinance Code to allow filling, grading, and seeding at the northeast corner of Excelsior Boulevard and Highway 100 within a PUD, Planned Unit Development District having the following legal description: The West 967.1 feet of the Northwest 1/4 of the Northwest 1/4, Section 7, Township 28, Range 24, which lies East of the East right-of-way line of State Highway No.' 100, South of the South right-of-way line of West 39th Street, Northerly of the northerly right-of-way line of Excelsior Boulevard. (Abstract and Torrens) WHEREAS, the City Council has considered the advice and recommendation of the staff as well as the effect of the proposed filling, grading, and seeding on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 87-64 of the St. Louis Park City Council dated June 15, 1987 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 87-64 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 87-64 (filed as Document No. 5333915) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting filling, grading, and seeding within the PUD, Planned Unit Development District at the location described above based on the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A - Site Plan; Exhibit B - Parking Level One; Exhibit C - First Floor Plan; Exhibit D - Skyway Plan; Exhibit E - Landscape Plan; and Exhibit F - Elevation Plans, except as modified by the following conditions: 2. That the uses be limited to a retail shopping mall containing no more than 205,000 square feet of gross floor area, one high rise office building containing 152,600 square feet of gross floor area, one, low rise office building containing 120,100 square feet of gross floor area and one 200 room hotel. No more than 18,000 gross square feet shall be used for restaurant 'purposes. 3. That a total of 1,820 parking spaces be provided on the site, permitting a reduction of about 1,898 spaces equal to 41 percent provided; however, there shall be no charge for such parking to the customers, employees or persons doing business or serving the property, except for the heated parking underneath the office buildings. The applicant and its successors and assigns are responsible for increasing off-street parking if sufficient parking, is not provided. I 4. That a more complete landscape plan be submitted on or before August 1, 1987, identifying specific surface materials, tree sizes and species, street furniture, bus stop detail, street lighting and signage, landscaping and decorative treatment of the median island on The Avenue and on the private access road. Methods for water augmentation in said plan must include the realignment of the walkway on Excelsior Boulevard to match and other linkages as discussed. 5. That dedication of the proposed new right-of-way and vacation of the existing right- of-way adjacent to the west side of the development, be accomplished prior to commencement of construction. 6. That a detailed plan acceptable to the City and identifying specific provisions for centralized trash storage and collection, transformers, control boxes and similar equipment be provided prior, to commencement of construction. 7. That any rooftop equipment' or ground equipment that is permited must e completely screened from view. i 8. A security plan and operational plan for the skyway system and parking ramp be submitted to the City prior to construction of the skyways and/or parking ramp. 9. Modification of the site plan is hereby permitted to take into account the extra right -turn lane for the on-ramp at Highway 100, as discussed in the traffic report. i 10. The utility plan is general and illustrative only. A detailed utility plan is reuiqred and shall be submitted and ;approved by the City in connection with the subdivision of the property. 1 11. Approval is subject to executing an appropriate contract with the City regarding demolition of the existing water tower and construction of a new water tower reservoir. 12. At least 50% of the exterior faces of the parking ramp be of a material matching the material used on the retail shopping center, ofice buildings and hotel. 13. A sign policy applicable to; the site be developed on or before December 31, 1987. Said policy is subject to review and approval by the City. f 1 1 14. That a convenient and safe walkway, equivalent to a second level skyway connecting to the skyway at the south, be provided from the major parking ramp at the northeast corner of the development to the retail center. 15. That all improvements including buildings, parking, landscaping, lighting, and plazas be completed by October 15, 1990. 16. That the site be developed, used and maintained in accordance with Exhibit G - Filling, Grading, and Seeding Plan. 17. That the City of St. Louis Park be responsible for erosion control during the time period wherein the filling, grading and seeding plan is in effect. 18. That all improvements in accordance with Exhibit G - Filling, Grading, and Seeding Plan, be completed by October 31, 1989.
