RESOLUTION NO. 89-36
A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION 14-124.101(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING
TO ZONING TO PERMIT THE CONSTRUCTION OF A NURSING HOME FOR
PROPERTY ZONED PUD, PLANNED UNIT DEVELOPMENT DISTRICT, LOCATED
AT 3620 DECATUR AVENUE
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Minneapolis Federation for Jewish Service (Shllom Home West Inc.) has made
application to the City Council for a special permit under Section 14-124.101(2) of the
St. Louis Park Ordinance Code for the purpose of the construction of a nursing home within
a PUD, Planned Unit Development District located at 3620 Decatur Avenue for the legal
description as follows, to -wit:
Lots 1, 2, 3 and 4, Block 1, The Federation Addition (Torrens Certificate
No. 687181 & 687182)
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 89 -5 -SP) and the effect of the proposed construction of a nursing
home on the health, safety and welfare of the occupants of the surrounding lands, existing
and anticipated traffic conditions, the effect on values of properties in the surrounding
area, the effect of the use on the Comprehensive Plan, and compliance with the intent of
the Zoning Ordinance.
3. The Council has determined that the construction of a nursing home will not be
detrimental to the health, safety, or general welfare of the community nor will it cause
serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property
values, and the proposed nursing home is in harmony with the general purpose and intent
of the Zoning Ordinance and the Comprehensive Plan.
4. The contents of Planning Commission Case Number 89 -5 -SP are hereby entered
into and made part of the public hearing record and the record of decision for this case.
Conclusion
The special permit to permit construction of a nursing home at the location described is
granted based on the findings set forth above and subject to the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A
- Site Plan dated February 21, 1989; Exhibit B - Landscaping Plan dated February
20, 1989; Exhibit C - Exterior Elevations, sheet A 14; and Exhibit D - Exterior,
sheet A 16; Exhibit E - Grading, Drainage and Erosion Control Plan; Exhibit F
- Utilities Plan.
2. No building permit shall be issued for this project until a noise study satisfactory
to the Department of Inspectional Services has been received and approved and
that adequate sound proofing measures be instituted.
3. The applicant shall demonstrate approval by the Department of Transportation of
the proposed drainage plan.
4. A survey creating the adjusted lot line shall be filed with the City and shall be
approved and recorded before issuance of a building permit.
5. The exterior finish of the building shall be subject to the Architectural Control
Ordinance.
6. The Utility Plan shall be adjusted to provide adequate fire hydrants spacing.
7. The cul-de-sac shall be enlarged to meet a radius of 55 feet.
8. Additional landscaping shall be provided along Highway 169 which would meet
the approval of staff.
9. All improvements on the site shall be completed by March 1, 1991, with the
exception of landscaping which shall be completed by May 31, 1991.
