A RESOLUTION OF FINDINGS REGARDING THE APPLICATION OF
MINNESOTA TEACHERS REALTY CORP. (KNOLLWOOD
COMPANY) FOR A VARIANCE UNDER SECTION 14-185.08 OF THE
ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO
PERMIT A FREE STANDING SIGN WITH A HEIGHT OF 31 FEET
INSTEAD OF THE REQUIRED 25 FEET, AND A MAXIMUM SIGN
SIZE OF 207 SQUARE FEET INSTEAD OF THE REQUIRED 100
SQUARE FEET FOR PROPERTY LOCATED IN THE PUD, PLANNED
UNIT DEVELOPMENT DISTRICT, AT 8332 HIGHWAY 7
BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota:
1. On January 19, 1989, Minnesota Teachers Realty Corp. (Knollwood Company)
filed an application seeking a variance to permit a free standing sign with a
height of 31 feet instead of the required 25 feet, and a maximum sign size of
207 square feet instead of the required 100 square feet, for property located
in the PUD, Planned Unit Development District, at 8332 Highway 7, for the
following legal description, to wit:
Commencing at intersection of North line of South 1/2 of Southeast
1/4, Section 18, Township 117 North, Range 21 West, with center
line of Aquila Ave; thence Southerly along said center line to
Northerly line of State Highway No. 7; thence Easterly along said
Northerly line to West line of East 417.62 feet of South 1/2 of
Southeast 1/4; thence North along said West line to South line of
North 499.5 feet thereof; thence West along said South line to
West line of East 783 feet of South 1/2 of Southeast 1/4; thence
North along West line thereof to North line thereof; thence West
to beginning, except roads (Abstract)
2. On January 26, 1989, the Board of Zoning Appeals reviewed the request and
recommended denial of the variance on a vote of 4-1.
3. On February 21, 1989, the City Council held a public hearing, received testimony
from the public, discussed the application, continued the public hearing to March
6, 1989, and authorized preparation of a resolution of denial on a vote of 5-0.
4. Based on the testimony, evidence presented, and files and records, the City
Council makes the following findings:
a. The requested variance does not meet the requirements of Sections 14-219
and 14-220.11 of the Zoning Ordinance necessary to be met for the City
Council to grant variances. There are no factors related to the shape, size
or other extraordinary conditions of the lot which prevent a reasonable use.
b. -• Granting of the requested variance is not necessary for the preservation
and enjoyment of a substantial property right. The property has had a
reasonable use in the past.
c. Granting of the requested variance would be contrary to the intent and
provisions of the Zoning Ordinance since, if granted, it would permit a free
standing sign with a height of 31 feet instead of the required 25 feet, and
a maximum sign size of 207 square feet instead of the required 100 square
feet
d. There is no demonstrable or undue hardship under the terms of the Zoning
Ordinance or Minnesota Statute, and therefore, conditions necessary for
granting the requested variance do not exist.
CONCLUSION
The applicant's request for a variance to permit a free standing sign with a height
of 31 feet instead of the required 25 feet, and a maximum sign size of 207 square
feet instead of the required 100 square feet at 8332 Highway 7 is hereby denied
based on the findings set forth above.
