RESOLUTION NO. 89-196
A RESOLUTION RESCINDING RESOLUTION NO. 89-148 ADOPTED ON
OCTOBER 2, 1989 AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-124.101 OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO ALLOW OPEN STORAGE
OF GOLF CARTS AND SEMI -TRAILERS AT 5105 W. 35TH STREET
FINDINGS
WHEREAS, Thomas E. Mundy, E -Z Go Division of Textron, Inc., (John and Jane Mooty)
has made application to the City Council for a special permit under Section 14-124.101 of
the St. Louis Park Ordinance Code to allow open storage of golf carts and semi -trailers for
property located in the PUD, Planned Unit Development District at 5105 W. 35th Street
having the following legal description:
Lot 2, Block 3, Belt Line Industrial Park (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission Case No. 89 -100 -SP, 89 -76 -SP, and 82 -91 -SP and the effect of the
proposed open storage of golf carts and semi -trailers on the health, safety, and welfare of
the occupants of the surrounding lands, existing and anticipated traffic conditions, the
effect on values of properties in the surrounding area and the effect of the use on the
Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 89-148 of the St. Louis Park City Council dated October 2, 1989 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions of
the permit granted by Resolution No. 89-148 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Commission Case File 89 -100 -SP, 89 -76 -SP and 82-
91 -SP are hereby entered into and made part of the public hearing record and the record of
decision for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 89-148 filed as Document
No. 5585209 is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting open
storage of golf carts and semi -trailers within the PUD Planned Unit Development District
at the location described above based on the following conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A,
Mudcat Facility Lot Improvement dated 8-30-82.
2. Materials may not be stored outside, except inside a trailer, which may be parked on
the site.
3. Lighting of the site shall not exceed a height of 25 feet and shall employ light fixtures
which direct the light rays perpendicularly to the ground.
4. The interior of the building may be used for offices, storage, repair and recycling and
redemption facilities.
5. All improvements on this site shall be completed by October 31, 1990.
6. Condition numbers 2 and 5 shall be eliminated.
7. Materials to be stored outside shall be located within the fenced in area and piled or
otherwise placed so as not to exceed a height of six feet except in trailers which may
be parked on the site.
8. All improvements on this site shall be completed by December 18, 1990.
9. This special permit expires on December 31, 1994.
