RESOLUTION NO. 89-170
ORDERTNG THE ABATEMENT OF A
HAZARDOUS BUILDING AT 4210 WOODDALE AVENUE SOUTH,
ST. LOUIS PARK, MINNESOTA
WHEREAS, Doris A. Jacobson is the fee owner of record of real
property located at 4210 Wooddale Avenue South and legally
described in Hennepin County as:
Lot 20, Block 5, Wooddale Park Addition to
St. Louis Park
(hereinafter referred to as the "Property"); and
WHEREAS, through information provided by its Inspectional
Services Department, the City Council of the City of St. Louis Park
has made the following findings of fact regarding the structure
located on the Property.

1. The flooring in the house is badly deteriorated and in
need of replacement.
2. The existing toilet facility is inoperable, the sink drain
has no trap and drains into a pail.
3. Footings for ttie walk -out vestibule at the rear of the
house are either failed or in poor repair; the vestibule is in a
dilapidated condition.
4. Windows contain either partial screens or no screens and
many have bird nests between the screen remnants and the windows.
5. Acoustic tile on the living roomceiling is deteriorated and
is falling.
6. The roof is over -spanned and roof rafters are sagging.
-7. The exterior of the house does not have a complete paint
finish, in spite of a Court citation issued on September 22, 1988
for lack of paint on the house.
8. The house is filled with garbage to the point of allowing
only narrow passageways through the interior of the house. The
stench from filth, waste, an animal carcass and rodents is highly
potent.; and
WHEREAS, the house structure located upon the Property is
vacant; and
WHEREAS, every attempt has been made to contact Doris Jacobson,
including correspondence to her daughter and son, with no response;
and
WHEREAS, in order to perform a complete inspection of the
vacant house, a search warrant was executed on behalf of the City
on July 19, 1989; and
WHEREAS, due to the hazardous nature of the building and the
immediate danger to residents within the area, the City Director of
Inspections, pursuant to Minn. Stat. § 463.251 secured and boarded
the vacant house on the Property on September

WHEREAS, as a result of the inspection of the

Property, the
City Director of Inspections has recommended that the house
structure be razed and removed, the foundation structure be removed
one to two feet below natural grade, and that the City sewer and
water be properly abandoned with appropriate permits.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
THE CITY COUNCIL OF THE CITY OF ST. LOUIS PARK HEREBY ORDERS:
1. Pursuant to its consideration of Minn. Stat. §§ 463.152 to
463.261, the City Council hereby declares the vacant structure on
the Property to be unsafe and hazardous to the public health,
safety, and welfare of the citizens of St. Louis Park and hereby
orders the record owner of the above Property, or her
representatives, to raze and remove the house structure within
twenty (20) days of the service of this Order.
2. All personal property and fixtures that may unreasonably
interfere with the razing and removal of the structure on the
Property shall be removed within the same twenty (20) days. If
such personal property and fixtures are not removed by the owner
and/or her representatives, the City of St. Louis Park may remove
and sell such personal property and fixtures at a public auction in
accordance with Minn. Stat. §§ 463.24 and 463.21, and shall credit
the amount received, if any, from such auction, upon Order of the
District Court, to the cost of razing and removing the house upon
the Property.
3. Unless corrective action is taken or an Answer is served
upon the City of St. Louis Park and filed in the Office of the
Clerk of District Court, Hennepin County, State of Minnesota within
twenty (20) days of the date of the service of this Order, a Motion
for Summary Enforcement of this Order will be filed with Hennepin
County District Court.

4. If the City of St. Louis Park is compelled to take
corrective action on the property, all necessary costs expended by
the City of St. Louis Park, its employees, officers or agents,
including attorneys' fees, will be assessed against the Property
and collected in accordance with Minn. Stat. § 463.22.
5. The Mayor, City Manager, employees and agents of the City
of St. Louis Park and the City Attorney are authorized and directed
to take action and prepare, sign, and serve documents as are
necessary to comply with this Order, and to assess the costs,
incurred against the Property described hereinabove, in a manner
described in Minn. Stat. § 463.22.
