SPS 6i" 1. Hoigaards Inc. owners and subdividers of the land proposed to be platted as Hoigaard Addition have submitted an application for approval of preliminary plat of said subdivision in the manner required for platting of land under the St. Louis Park Ordinance Code, and all proceedings have been duly had thereunder. 2. The proposed preliminary plat has been found to be in all respects consistent with the City Plan and the regulations and requirements of the laws of the State of Minnesota and the ordinances of the City of St. Louis Park. 3. The proposed plat is situated upon the following described lands in Hennepin County, Minnesota, to -wit: Lots 10 through 34, inclusive Block 26, and Lots 3 through 13 inclusive, Block 75, including all of vacated Webster Avenue and all vacated alley adjoin said lots, all in rearrangement of st. Louis Park. And That part of Lots 1 through 10, both inclusive, Block 14, Collin's addition to st. Louis Park, in the County of Hennepin, state of Minnesota, lying Westerly of the West right-of-way line of State Trunk Highway No. 100, and Southerly of the right-of-way line of the Chicago, Milwaukee, St. Paul, and Pacific Railroad, said south right-of-way being parallel to and 50.00 feet South of, as measured at right angles to, the centerline of the main track of said railroad, as laid out and traveled. And That part of the Northwest Quarter of the Southwest Quarter of Section 6, Township 28, Range 24, lying southerly of the right-oflway of the Chicago, Milwaukee, St. Paul and Pacific Railway Company and Westerly and Northerly of the right-of-way of State Highway Number 100. Conclusion 1. The proposed preliminary plat of Hoigaards Inc. is hereby approved and accepted by the City as being in accord and conformity with all ordinances, City plans and regulations of the City of St. Louis Park and the laws of the State of Minnesota, subject to the following conditions: A. Necessary easements, as identified, must be provided on the Final Plat. B. Proceedings for vacation of the alley on the westerly portion of the property must be initiated. C. That the developer provide an agreement to the City indemnifying the City from liability relating to the climbing tower, in written form acceptable to the City Attorney.
