RESOLUTION NO. 89-167
A RESOLUTION RESCINDING RESOLUTION NO. 7169 ADOPTED ON
JULY 6, 1982 AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT
UNDER SECTION 14-150(3)(A) OF THE ST. LOUIS PARK ORDINANCE
CODE RELATING TO ZONING TO ALLOW A GASOLINE SERVICE
STATION AT 7119 MINNETONKA BOULEVARD
FINDINGS
WHEREAS, Pump and Meter Service Inc. has made application to the City Council for a
special permit under Section 14-150(3)(a) of the St. Louis Park Ordinance Code to allow a
gasoline service station at 7119 Minnetonka Boulevard within a B-1, General Business
District having the following legal description:
Lots 5, 6, and 7, Block 8 "Lenox" except road (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission Case No. 89 -86 -SP and 82 -33 -SP and the effect of the proposed
gasoline service station on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area and the effect of the use on the Comprehensive Plan;
and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 7169 of the St. Louis Park City Council dated July 6, 1982 which contained
conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions of
the permit granted by Resolution No. 7169 to add the amendments now required, and to
consolidate all conditions applicable to the subject property in this resolution;
WHEREAS, the contents of Planning Commission Case File 89 -86 -SP and 82 -33 -SP are
hereby entered into and made part of the public hearing record and the record of decision
for this case.
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 7169, no document number
filed, is hereby rescinded and replaced by this resolution which continues and amends a
special permit to the subject property for the purposes of permitting a gasoline service
station within the B-1, General Business District at the location described above based on
the following conditions:
1. That the site shall be developed, used and maintained in accordance with Exhibit A,
Site Plan except that the canopy shall be constructed as shown on Exhibit B.
2. Any new sign to be erected must conform to the setback requirements of the Zoning
Ordinance. The present pylon sign shall be allowed to continue to exist and the three
product price sign presently on the northeast corner of the site shall be allowed to be
moved onto the pylon sign.
3. That the landscaping on the property shall be developed in accordance with Exhibit
A, as modified to include:
A. A 15 foot by 25 foot landscaped island at the southeast corner of the site. The
island shall be separated from the drive area by a 6" poured in place concrete
curb and shall contain shrubs or trees with a minimum mature height of 6
feet.
B. That the trunk diameter of the proposed Sapporo Elm be a minimum of 2 1/2
inches measured 1 foot above the ground.
C. That the landscaped islands contain a turf grass or other live ground cover in
addition to trees and shrub material.
4. That all improvements contained in conditions one through three be completed by
October 1, 1990.
