RESOLUTION NO. 89-154
A RESOLUTION FINDING THE FINAL ENVIRONMENTAL IMPACT
STATEMENT FOR THE MINNEAPOLIS WEST BUSINESS CENTER PROJECT
ADEQUATE PURSUANT TO MINNESOTA STATUTES CHAPTER 116D.04 2a (g)
WHEREAS, Minnesota Statutes Chapter 116D.04 2a (g) requires the City to
determine the adequacy of a final Environmental Impact Statement prepared pursuant to
State rules and regulations, and
WHEREAS, the City Council authorized distribution of the final Environmental
Impact Statement (EIS) for the Minneapolis West Business Center project on August 3,
1989, and
WHEREAS, the comment period on the final EIS closed on September 6, 1989.
THEREFORE, the City hereby makes the following
FINDINGS
1. The fmal EIS addresses the issues raised in scoping in such a fashion that all issues
for which information could be reasonably obtained have been analyzed, and
2. The fmal EIS provides responses to the substantive comments received during the
draft EIS review concerning issues raised in scoping, and
3. The fmal EIS was prepared in compliance with the procedures required by law, and
4. The City is not approving any of the permits or zoning needed to develop any part or
all of the project as set forth in the EIS and the City is not granting any vested or
other rights to construct any portion of the project by approval of this EIS, and
5. The City is not committing itself to construct or pay for any of the public or private
improvements identified in the EIS as being necessary or recommended in order to
facilitate the project, and
6. The traffic related impacts identified in the EIS may be further mitigated by action of
the City's Traffic Management Ordinance (Chapter 14-124.201 of the City Code), and
7. Much of the analysis in the EIS presupposes that the portion of the project located in
the City of Golden Valley will be approved by the City of Golden Valley in such a way
that the impacts on site and off site from that portion of the project will be
adequately addressed by the City of Golden Valley and the developer in full
cooperation with the City of St. Louis Park, and
8. The City reserves to itself the authority to require that the developer conduct
additional traffic, storm sewer and other analyses as the City may deem necessary at
such time as the developer applies for permits, zoning and subdivision approvals for
each phase of the project, including, but not limited to, a supplemental EIS as allowed
by law, and
9. The City reserves the right to comment upon and make recommendations to the
Minnesota Pollution Control Agency regarding the Indirect Source Permit which the
developer must obtain for all or a portion of the project.
Subject to the terms and findings of this resolution, the City of St. Louis Park hereby fmds
the fmal Environmental Impact Statement for the Minneapolis West Business Center to be
adequate. The City is approving this resolution in reliance upon the agreement of the
applicants set forth below and in reliance upon the assumed validity of the provisions of this
resolution.

The developer states that the developer has read the above and agrees that it, and the
property described therein, shall be bound by the terms thereof on behalf of itself, its
successors and assigns.
