HomeMy WebLinkAbout89-152 - ADMIN Resolution - City Council - 1989/10/02RESOLUTION NO. 89-152 A RESOLUTION RESCINDING RESOLUTION NO. 89-20 ADOPTED ON FEBRUARY 21, 1989, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-141(7) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW AN OFFICE USE FOR PROPERTY ZONED R-4, MULTIPLE FAMILY RESIDENCE DISTRICT, LOCATED AT 7825 WAYZATA BOULEVARD. FINDINGS WHEREAS, Kurt A. Anderson has made application to the City Council for a special permit under Section 14-141(7) of the St. Louis Park Ordinance Code to allow an office use at 7825 Wayzata Boulevard within an R-4, Multiple Family Residence District having the following legal description: That part of the west 67.5 feet of the east 802.5 feet of the north 162.5 feet of the Northwest Quarter of the Southwest Quarter of Section 5, Township 117 North, Range 21 West, Hennepin County, Minnesota, lying southerly of the southerly right-of-way line of Trunk Highway No. 394 as now located and established (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case No. 88 -103 -SP) and the effect of the proposed office use on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 89-20 of the St. Louis Park City Council dated February 21, 1989 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 89-20 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; WHEREAS, the contents of Planning Commission Case File 88 -103 -SP are hereby entered into and made part of the public hearing record and the record of decision for this case. CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 89-20 filed as Document No. 5510165 is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting an office use within the R-4, Multiple Family Residence District at the location described above based on the following conditions: 1. That the site be developed, used and maintained according to Exhibit A - Site Plan. 2. That the parking lot be paved and a bituminous curb be installed. 3. Improvements to the property be completed by July 1, 1989, except the proposed landscaping, which shall be installed by June 1, 1993. 4. Condition No. 3 is hereby amended to extend the completion date for all improvements to December 31, 1990, except the proposed landscaping, which shall be installed by June 1, 1993.
